Mumbai, The Maharashtra chief secretary has ordered the immediate cancellation of the appointments of officers and employees made in ministerial offices and state departments on deputation, on a loan basis, or merely by oral orders, without following the prescribed procedure. Maharashtra: ‘Oral’ appointments of officers and employees in ministerial offices cancelled In a circular issued on Tuesday, Chief Secretary Rajesh Aggarwal directed that all such officials and employees must be sent back to their parent offices by September 10. It said appointments were being made without following the prescribed procedure. A large number of technical personnel, including doctors, stenographers, teachers and engineers, had also been appointed. Many of them lacked training or experience in ministerial work, affecting the functioning of the Mantralaya and established administrative processes. These appointments were made without obtaining the required approvals of the parent ministerial department, the additional chief secretary , the chief secretary and the chief minister, according to the circular. A Bench headed by Chief Justice of India Surya Kant issued notice to the Delhi government and the DERC on a petition filed by NGO, Energy Watchdog, represented by advocate Pranav Sachdeva, who argued that a dysfunctional DERC would result in petitions and applications seeking redress in electricity and energy-related issues pile-up in the national capital. The petition said the government had not made any move to even include a judicial member on the DERC. “The present composition of DERC is wholly contrary to law as it consists of only two pro tem members; lacks a chairperson; and lacks a person of law as a member, contrary to the mandate of the Supreme Court,” the petition said. In a 2023 judgment in Anoop Baranwal versus Union of India, a Constitution Bench of the court had replaced the mechanism of the President appointing the Chief Election Commissioner and Election Commissioners on the sole advice of the Prime Minister with a more participatory appointment process involving a three-member selection committee of the Prime Minister, the Opposition Leader in the Lok Sabha, and the Chief Justice of India.
