The Delhi High Court on Monday stayed the trial court order suspending the grant of bail to Indian Youth Congress (IYC) president Uday Bhanu Chi b. Justice Saurabh Banerjee observed that the sessions court’s decision to stay the bail appeared to lack proper reasoning. The judge said the order did not show adequate application of mind and therefore required intervention. “The key issue is whether there was any application of mind. If there is none, the order cannot stand. The judge himself noted that bail should be stayed only in rare and exceptional cases, but the order does not explain how this case falls into that category,” the High Court said during the hearing.
