The Delhi Police on Tuesday moved the Delhi high court against a city court’s order, directing the force to supply a list of “unrelied documents” to Aam Aadmi Party (AAP) convener Arvind Kejriwal’s aide Bibhav Kumar, in connection with the alleged assault of AAP parliamentarian Swati Maliwal. Though the matter was listed before a bench of justice Vikas Mahajan on Tuesday, it was adjourned for March 11 after the Delhi Police sought time to file a written note on its submissions in its appeal against the city court’s order. “At request renotify on March 11. Court asks prosecution to provide Bibhav list of `unrelied upon` documents

A court on Tuesday allowed an application of former chief minister Arvind Kejriwal`s aide Bibhav Kumar to supply a list of documents or material objects seized but not relied upon by the prosecution in the case of alleged assault on Rajya Sabha MP Swati Maliwal. Kumar, accused of assaulting Maliwal on May 13 at the former chief minister`s official residence, is currently out on bail. Judicial Magistrate Gaurav Goyal referred to some judicial precedents and said, “It is clear that the prosecution is required to supply a list of unrelied upon documents, along with the relied upon documents to the accused. Thus, the contention of the additional public prosecutor that the list of unrelied upon documents cannot be supplied does not hold water.” The court, however, made it clear that according to the precedents, only a list of documents had to be provided and that the prosecution was not required to provide the actual documents. “Accordingly, the state is directed to file a list of the statements and documents/material objects seized but not relied upon …

CM Kejriwal`s aide Bibhav Kumar walks out of jail after SC grants bail

Delhi Chief Minister Arvind Kejriwal`s aide Bibhav Kumar on Tuesday walked out of Tihar jail after getting bail in the Swati Maliwal assault case, official sources said. Kumar was released at 2 pm from jail number five, where he was lodged for more than three months, the sources added. On Monday, the Supreme Court had granted bail to Kumar, noting that he has been in custody for more than 100 days. A bench of Justices Surya Kant and Ujjal Bhuyan also took into account the fact that the prosecution has proposed to examine more than 51 witnesses and said the trial would take time to conclude. It also noted that since the charge sheet in the case has already been filed, Kumar`s release will not cause any prejudice to the investigation. Kumar allegedly assaulted Maliwal on May 13 at Kejriwal`s official residence. He was arrested by the Delhi Police on May 18. The Supreme Court on Monday granted bail to Delhi CM Arvind Kejriwal`s aide Bibhav Kumar in AAP Rajya Sabha MP Swati Maliwal assault case, the PTI reported. Last month, the had dismissed a plea by Bibhav Kumar challenging his arrest in connection with the alleged assault on AAP MP Swati Maliwal at the CM`s residence. “Petition dismissed,” Justice Neena Bansal Krishna had said. Kumar, presently in judicial custody, allegedly assaulted Swati Maliwal on May 13 at Kejriwal`s official residence. He was arrested on May 18. Kumar, in his plea, had sought a direction to declare his arrest as illegal and in gross violation of the provisions of Section 41A (notice of appearance before police officer) of the Code of Criminal Procedure and against the mandate of the law. Delhi Police had opposed the petition and submitted that Kumar was not arrested “in haste” and he was taken into custody as per the law. Mr Kumar has been interrogated and the statements of around 20 people have been recorded in connection with the case, the Delhi Police officer said. A DAY after Delhi Chief Minister Arvind Kejriwal’s aide, Bibhav Kumar, was arrested for allegedly assaulting AAP’s Rajya Sabha member Swati Maliwal, the Delhi Police has added the charge of destruction of evidence (IPC Section 201) in the FIR against him. Kumar, who was arrested on Saturday while his anticipatory bail plea was being heard, has already been booked under sections pertaining to assault, criminal intimidation and outraging a woman’s modesty. A Delhi court sent him to five days police custody late on Saturday. In its remand application, the Delhi Police alleged that a pen drive that was provided to them, which was supposed to contain the CCTV footage from May 13, when the alleged assault took place at Kejriwal’s residence, was empty. Police also alleged that Kumar had formatted his phone before being arrested.
