NEW DELHI: The Supreme Court on Thursday dismissed the Gujarat government’s plea seeking a review of the order setting aside the remission granted to the 11 convicts in the Bilkis Bano gang rape case of 2002. The top court’s January 8 order had made harsh observations against the state for being “complicit” and “acting in tandem” with the accused — statements that the Gujarat government wanted reviewed and expunged. The case involves the early release of 11 people convicted of raping Bilkis Bano during the 2002 Gujarat riots. The Supreme Court held that the Gujarat government’s plea to strike out certain points from its judgment was baseless. The court had earlier said that Gujarat had acted “in concert” with individual convicts who highlighted systemic issues in the riots The Gujarat government argued that the court’s findings were grossly biased and claimed that the state’s affairs had been misrepresented. (Representational) New Delhi: Two of the 11 convicts in the Bilkis Bano case have moved the Supreme Court contending that its January 8 verdict cancelling remission of their sentence was “in teeth of” a 2002 constitution bench order and sought the issue to be referred to a larger bench for “final” adjudication. Radheyshaym Bhagwandas Shah and Rajubhai Babulal Soni, both lodged in Godhra sub-jail after the Supreme Court verdict, said an “anomalous” situation has arisen wherein two different coordinate benches (benches of same strength) have taken diametrically opposite view on the same issue of premature release as well as on which policy of the state government would be applicable to the petitioners for remission. Gujarat seeks review of adverse comments in Bilkis Bano judgment

Stung by the adverse remarks passed against it, the Gujarat government moved a review petition in the Supreme Court on Tuesday to reconsider the comments in the Bilkis Bano case judgment. A Bench led by Justice B.V. Nagarathna had quashed the State’s move to remit the life sentence of the 11 convicts accused of gangrape and murder in the case. The court, in its judgment, had directed the men to surrender. Close to deadline, Bilkis Bano case convicts surrender, reach Godhra jail | India News

Eleven convicts in the Bilkis Bano case surrendered before the Godhra jail authorities late Sunday night, in line with the stipulated two-week deadline set by the Supreme Court on January 8. The court had annulled the remission and premature release granted to the convicts by the Gujarat government on August 15, 2022. The 11 convicts — Radheshyam Shah, Jaswant Nai, Govind Nai, Kesar Vohania, Baka Vohania, Raju Soni, Ramesh Chandana, Shailesh Bhatt, Bipin Joshi, Pradip Modhiya, and Mitesh Bhatt — arrived from Singwad in Dahod district to the Godhra sub-jail in Panchmahal district shortly before midnight, in two separate vehicles. Most of the convicts arrived in a 10-seater multi-utility vehicle that was led by an SUV – the two cars made their way into the jail premises within minutes of each other. Officials of the district police confirmed that they had “tracked and escorted” all 11 accused into the jail premises. Chandrachud and judges of the Supreme Court held a Full Court meeting on Friday to designate 56 lawyers as senior advocates. Eleven of the advocates-on-record and advocates designated senior advocates by the Supreme Court are women, including Shobha Gupta, who successfully appeared for Bilkis Bano against the remission granted by the Gujarat government to 11 life convicts. Section 16 of the Advocates Act refers to the separate class of ‘senior advocate’. Both the Supreme Court and High Courts can confer senior designation to lawyers based on their merit, experience, special knowledge of the law and standing at the Bar. Section 23 of the Act says, “senior advocates shall have pre-audience over other lawyers and their right of pre-audience inter se shall be determined by their respective seniority”. On Monday, the Supreme Court had cancelled the remission granted by the Gujarat government. Mumbai: NCP chief Sharad Pawar on Tuesday appealed to the Maharashtra government to take the case of Bilkis Bano – who was gang raped and her seven family members murdered in 2002 – seriously and keep in mind what the Supreme Court has said about the “heinous crime”. The Supreme Court on Monday cancelled the remission granted by the Gujarat government to 11 convicts in the case, while slamming the state for being “complicit” with an accused and abusing its discretion.
