The Supreme Court on Tuesday asked the Gujarat and Maharashtra governments to respond to appeals filed by two convicts in the Bilkis Bano gangrape case of 2002 against their conviction and the sentence of life imprisonment handed out to them by the Bombay high court in 2017. The two, represented by senior advocates Sidharth Luthra and Sonia Mathur, are the first to challenge their conviction in the March 2002 case amid the Gujarat communal riots when Bano was trying to escape along with her family. The riots broke out in the aftermath of the torching of the Sabarmati Express at Godhra on February 27, 2002. NEW DELHI: The Supreme Court on Thursday dismissed the Gujarat government’s plea seeking a review of the order setting aside the remission granted to the 11 convicts in the Bilkis Bano gang rape case of 2002. The top court’s January 8 order had made harsh observations against the state for being “complicit” and “acting in tandem” with the accused — statements that the Gujarat government wanted reviewed and expunged. The Gujarat government pointed out that it had followed an earlier order of the Supreme Court. New Delhi: A month after the Supreme Court ordered that the 11 men convicted of raping Bilkis Bano and killing her family during the 2002 riots must return to jail, the Gujarat government has approached the court and sought the removal of some “adverse” comments made against it in the judgment.  In its order on January 8, the Supreme Court bench of Justices BV Nagarathna and Ujjal Bhuyan had observed that “State of Gujarat has acted on the basis of the direction issued by this Court but contrary to the letter and spirit of law” and  “acted in tandem and was complicit with” one of the convicts in the case who had played a fraud on the court and misrepresented or suppressed material facts. All 11 convicts in the 2002 Bilkis Bano gangrape case surrendered at a Gujarat jail on Sunday night in line with the Supreme Court enforced deadline.  They surrendered at Godhra sub jail in Panchmahal district. “All 11 convicts have surrendered before jail authorities late Sunday night,” local Crime Branch inspector NL Desai told news agency PTI. The Supreme Court on January 8 asked the convicts, released prematurely on Independence Day in 2022, to surrender before jail authorities by January 21. On Friday, the court refused to grant them more time. The convicts had cited reasons such as health issues, impending surgery, marriage in the family and harvest work and sought more time to surrender. New Delhi: The Supreme Court today cancelled the Gujarat government’s decision to grant release to 11 men who raped Bilkis Bano and killed her child and other family members in 2002. The convicts walked free on Independence Day in 2022 under an outdated remission policy of the Gujarat government, setting off a huge political controversy. Ms Bano approached the Supreme Court in November 2022 challenging what she called “premature” release of the 11 convicts by the state government.
