The Supreme Court on Tuesday asked the Gujarat and Maharashtra governments to respond to appeals filed by two convicts in the Bilkis Bano gangrape case of 2002 against their conviction and the sentence of life imprisonment handed out to them by the Bombay high court in 2017. The Supreme Court issued notice to the Maharashtra and Gujarat governments (PTI FILE) A bench of justices Rajesh Bindal and Vijay Bishnoi issued notice on the appeals moved by Bipinchand Kanaiyalal Joshi and Pradip Ramanlal Modhiya and posted the matter for hearing on May 5. The two, represented by senior advocates Sidharth Luthra and Sonia Mathur, are the first to challenge their conviction in the March 2002 case amid the Gujarat communal riots when Bano was trying to escape along with her family. The riots broke out in the aftermath of the torching of the Sabarmati Express at Godhra on February 27, 2002. The Supreme Court (SC) on Thursday dismissed a plea filed by the Gujarat government seeking a review of the court`s verdict which contained certain observations against the state while quashing the remission granted to 11 men convicted of raping Bilkis Bano and murdering seven of her family members during the 2002 riots, news agency PTI reported. A bench of Justices B V Nagarathna and Ujjal Bhuyan also rejected the application for listing the review petition in open court. “Having carefully gone through the Review Petitions, the order under challenge and the papers annexed therewith, we are satisfied that there is no error apparent on the face of the record or any merit in the Review Petitions, warranting reconsideration of the order impugned. The Review Petitions are, accordingly, dismissed,” the bench said. The case involves the early release of 11 people convicted of raping Bilkis Bano during the 2002 Gujarat riots. The Supreme Court held that the Gujarat government’s plea to strike out certain points from its judgment was baseless. The court had earlier said that Gujarat had acted “in concert” with individual convicts who highlighted systemic issues in the riots The Gujarat government argued that the court’s findings were grossly biased and claimed that the state’s affairs had been misrepresented. (Representational) New Delhi: Two of the 11 convicts in the Bilkis Bano case have moved the Supreme Court contending that its January 8 verdict cancelling remission of their sentence was “in teeth of” a 2002 constitution bench order and sought the issue to be referred to a larger bench for “final” adjudication. Radheyshaym Bhagwandas Shah and Rajubhai Babulal Soni, both lodged in Godhra sub-jail after the Supreme Court verdict, said an “anomalous” situation has arisen wherein two different coordinate benches (benches of same strength) have taken diametrically opposite view on the same issue of premature release as well as on which policy of the state government would be applicable to the petitioners for remission. Gujarat seeks review of adverse comments in Bilkis Bano judgment

Stung by the adverse remarks passed against it, the Gujarat government moved a review petition in the Supreme Court on Tuesday to reconsider the comments in the Bilkis Bano case judgment. A Bench led by Justice B.V. Nagarathna had quashed the State’s move to remit the life sentence of the 11 convicts accused of gangrape and murder in the case. The court, in its judgment, had directed the men to surrender. The Gujarat government pointed out that it had followed an earlier order of the Supreme Court. New Delhi: A month after the Supreme Court ordered that the 11 men convicted of raping Bilkis Bano and killing her family during the 2002 riots must return to jail, the Gujarat government has approached the court and sought the removal of some “adverse” comments made against it in the judgment.  In its order on January 8, the Supreme Court bench of Justices BV Nagarathna and Ujjal Bhuyan had observed that “State of Gujarat has acted on the basis of the direction issued by this Court but contrary to the letter and spirit of law” and  “acted in tandem and was complicit with” one of the convicts in the case who had played a fraud on the court and misrepresented or suppressed material facts.
