Cash-for-query row: Delhi HC quashes Lokpal sanction against Mahua Moitra

The Delhi High Court on Friday set aside a Lokpal order granting sanction to the Central Bureau of Investigation (CBI) to file a charge sheet against Trinamool Congress MP Mahua Moitra in connection with the alleged cash-for-query row.   A bench of Justices Anil Kshetarpal and Harish Vaidyanathan Shankar allowed Moitra’s plea challenging the Lokpal’s sanction order and directed the Lokpal to reconsider the issue in accordance with law and take a fresh decision within one month. Setting aside the impugned order, the Justice Kshetarpal-led Bench accepted Moitra’s contention that the anti-corruption body had failed to properly consider the statutory requirement of examining the comments and material submitted by the public servant before granting sanction under Section 20(7)(a) of the Lokpal and Lokayuktas Act, 2013. The case arose from allegations levelled by Bharatiya Janata Party (BJP) MP Nishikant Dubey, who accused Moitra of accepting cash and luxury gifts from Dubai-based businessman Darshan Hiranandani in exchange for raising questions in the Parliament. The Delhi High Court on Friday set aside an order of the Lokpal that had granted sanction to the Central Bureau of Investigation (CBI) to file a chargesheet against TMC Lok Sabha MP Mahua Moitra in relation to the cash-for-query row. Moitra, in a plea before the Delhi HC, had challenged the Lokpal’s November 12 order, primarily on the ground that it was passed without taking into consideration her submissions and filings before the anti-corruption ombudsman in violation of the prescribed procedure under Section 20 (7) of the Lokpal Act. A division bench of Justices Anil Kshetarpal and Harish Vaidyanathan Shankar, pronouncing the verdict in open court, also remanded the matter back to Lokpal to reconsider the aspect of grant of sanction as per the provisions of the Act, and take a decision in a month’s time. In a November 12 full-bench decision, Lokpal invoked its powers and approved the sanction under relevant sections of the Lokpal Act for the CBI to prosecute Moitra and others. The authority asked the probe agency to file the chargesheet in court within four weeks, and also to submit a copy to the Lokpal, news agency ANI reported. Cash-for-query row case: ED files money laundering case against Mahua Moitra

The Enforcement Directorate (ED) has filed a money laundering case against Trinamool Congress leader Mahua Moitra in cash-for-query row case, sources said. This is the second case which the ED so far has registered against Moitra. The first one is linked to the discrepancies in a foreign exchange contravention case under which the ED has issued three summons to Moitra and she did not appear yet before the investigators in response to the case. The FIR registered by CBI Thursday against former TMC MP Mahua Moitra in connection with the alleged cash-for-query case also mentions businessman Darshan Hiranandani as an “accused”. On Saturday, multiple teams of the CBI had conducted searches at various premises linked to Moitra, across different locations in West Bengal. Moitra has been accused of accepting cash to ask questions on behalf of businessman and friend Hiranandani. In an interview to The Indian Express on October 27, Moitra admitted she gave her Parliament login and password details to Hiranandani but denied taking any cash from him, as alleged by Supreme Court advocate Jai Anant Dehadrai in his complaint to the CBI. New Delhi: Anti-corruption ombudsman Lokpal on Tuesday directed the CBI to investigate the cash-for-query allegations against Trinamool Congress (TMC) leader Mahua Moitra and submit findings before it within six months, according to an order. Ms Moitra was expelled from the Lok Sabha in December last year for “unethical conduct” and has moved the Supreme Court challenging her expulsion. She has been renominated by the party as its candidate from the Krishnanagar Lok Sabha seat in West Bengal. Mahua Moitra submits her response to CBI questions in `cash-for-query` case

TMC leader and former Lok Sabha member Mahua Moitra has sent her response to a questionnaire by the CBI on allegations of corruption in raising questions in the house, officials said Thursday. The CBI is examining the response after which it will send a report to anti-corruption ombudsman Lokpal which had referred the matter to the agency, they said. The agency is conducting a preliminary inquiry into the allegations against Moitra on the reference from the Lokpal. The CBI is also understood to have spoken to lawyer Jai Dehadrai and businessman Darshan Hiranandani in connection with its inquiry, they said. Queries sent by PTI to Moitra remained unanswered and the CBI has also maintained silence on the issue.
