Supreme Court dismisses PIL petition that challenged death by hanging | Explained

The story so far: On August 18, the Supreme Court upheld hanging as the method of executing a death sentence, dismissing a PIL petition challenging its constitutional validity. The Court held that its earlier decision upholding hanging continues to bind it and found no conclusive scientific evidence to establish that alternatives such as lethal injection are more humane. The matter was before the Bench of Justice Vikram Nath and Sandeep Mehta. Why was hanging challenged? The petitioner challenged the constitutional validity of Section 354(5) of the Code of Criminal Procedure, 1973, corresponding to Section 393(5) of the Bharatiya Nagarik Suraksha Sanhita, 2023, insofar it prescribes hanging as the sole method of executing a death sentence. The petition is from 2017. The central question before the Supreme Court was whether prescribing a single method of execution, hanging, conforms to the constitutional requirement of a procedure that is just, fair and reasonable. Justice Swarana Kanta Sharma, hearing a petition filed by disability rights lawyer Rahul Bajaj, on July 2 also directed the Central government to submit its response within two weeks. The Allahabad High Court on Wednesday, March 25, granted anticipatory bail to Saraswati in the POCSO case, citing a delay in filing the complaint by the informant and inconsistencies in the statements of the alleged victims. Police on Friday arrested two men for allegedly abducting and assaulting a married woman with mental health issues, an officer said. According to police, the case was registered on Thursday at Bansdih Police Station on a complaint lodged by the victim`s husband. Based on the complaint, the police booked two brothers — Santosh Kumar Thakur, alias Munna Thakur, and Rajesh Kumar Thakur, alias Guddu Thakur, aged 48 and 43. The FIR stated that on the night of February 27, the woman left her house and reached Kewra Chatti but was abducted by the two men on a motorcycle. They took her behind a cold storage facility in the area, where they assaulted her when she resisted the sexual advance, it read. Ms. Nathan, who is totally blind, was ranked first on the merit list of persons with benchmark disabilities in the recently held judicial service examination for the selection of Civil Judges (Junior Division) in the Kerala Judicial Service. Joyson Sajan, with cerebral palsy, came second. It was a landmark judgment by a Supreme Court Bench consisting of Justices J.B. Pardiwala and R. Mahadevan in 2025, which noted that “visually impaired candidates cannot be said to be ‘not suitable’ for judicial service and they are eligible to participate in selection for posts in judicial service,” that paved the way for Ms. Nathan to become a judge.
