In Absence of Citizenship Document, How Do You Prove You Are Indian?

In Absence of Citizenship Document, How Do You Prove You Are Indian?

Citizenship is a vertical relationship between the individual and the state. Originally, citizenship used to signify a belief in certain liberal and republican ideas and did not have much to do with territory and status. Today, it is all about territory, status, and exclusion rather than inclusion. The Foreigners’ Tribunals in Assam reportedly denied citizenship to people despite some possessing as many as 15 documents. The judiciary, too, has become quite restrictive in this regard. In Shabbir Hussain’s (1951) case — a trader who got stuck in Lahore during Partition and returned to India only on a temporary permit but was subsequently arrested for overstaying in India — the apex court refused to treat him as a Pakistani national. Similarly, in Abdul Khader (1960), the Supreme (SC) Court refused to treat Khader as a foreigner despite his having a Pakistani passport. But in Izhar Ahmad Khan (1962), the court treated possession of a Pakistani passport as conclusive proof of Pakistani citizenship. By 2008, the Court had become even more restrictive when, in Razia Bergum, it held that even possession of …

Centre clarifies passport is not proof of citizenship, cites 1967 law

The Centre on Thursday clarified that an Indian passport has never been regarded as conclusive proof of citizenship, stating that no new policy has been introduced and that the legal position has remained unchanged for decades. The clarification came a day after the Ministry of External Affairs (MEA) stated during a media briefing that a passport is primarily a travel document and should not be treated as definitive proof of Indian citizenship. The remarks triggered criticism from Opposition leaders, prompting the government to explain the legal basis for its position. The government said the distinction is rooted in the Passports Act, 1967, and has also been upheld by judicial pronouncements, including a Bombay High Court ruling in 2013. Government cites Passports Act, 1967 In its clarification, the government referred to Section 20 of the Passports Act, 1967, which empowers the Central Government to issue a passport or travel document even to a person who is not an Indian citizen under specific circumstances. “Notwithstanding anything contained in the foregoing provisions relating to issue of a passport …

If not a passport, then what? MEA statement reignites citizenship debate

If not a passport, then what? MEA statement reignites citizenship debate

A passport can get an Indian across international borders, secure consular protection in a foreign country and establish nationality before immigration authorities worldwide. Yet, according to officials of the external affairs ministry, it is not proof of citizenship. Under Section 5 of the Passports Act, 1967, a passport authority may issue a passport only after considering the application and making such inquiry as it deems necessary. (Getty Images/iStockphoto) The seemingly technical clarification, made on Passport Seva Divas on Wednesday while unveiling the benefits of chip-enabled e-passports, has revived a long-standing legal question that has acquired renewed significance amid recent controversies over electoral roll revisions and citizenship verification exercises: if even a passport does not conclusively prove citizenship, what document does? The paradox The statement appears counter-intuitive because the very law governing passports proceeds on the premise that the holder is an Indian citizen. Under Section 5 of the Passports Act, 1967, a passport authority may issue a passport only after considering the application and making such inquiry as it deems necessary, while Section 6(2)(a) expressly …

Good news, bad news for Indians eyeing Canada: Work permits faster, PR and citizenship stuck | Chandigarh News

For thousands of Indians planning a move to Canada, the latest immigration processing data has delivered both hope and anxiety. Fresh figures released by Immigration, Refugees and Citizenship Canada (IRCC) between May 20 and 22 show a sharp divide in how quickly different applications are being processed. While some categories such as work permits and parents’ Super Visas have become significantly faster, others including citizenship applications and visitor record extensions are getting buried under mounting backlogs. The latest numbers are based on the time IRCC took to process 80 per cent of complete applications and experts say the fluctuations are among the sharpest seen this year. Relief for workers and families There is encouraging news for Indians seeking temporary entry into Canada. Processing time for inland work permits, including extensions filed within Canada, has dropped sharply over the past few months. Compared to late March, applicants are now waiting roughly 47 days less, with average timelines currently hovering around 206 to 212 days. For Indians applying for work permits from outside Canada, the wait remains …

‘Some people are more native, but it’s a question of citizenship’: Hiren Gohain

‘Some people are more native, but it’s a question of citizenship’: Hiren Gohain

At 87, writer and activist Hiren Gohain, one of Assam’s foremost public intellectuals, shows no sign of slowing down. The Assam Nagorik Sanmilani, a citizens’ collective led by him and retired IPS officer Harekrishna Deka, was at the forefront of calls for Opposition unity and seeking judicial intervention over a “sustained pattern of hate speeches” by Chief Minister Himanta Biswa Sarma. He discusses issues foregrounding the Assam election campaign with The Hindu. Edited excerpts: You were an adviser to the regional party Raijor Dal during its early days before dissociating yourself. Why then did you issue appeals for the Opposition to come together this Assembly election? I used to be adviser but Akhil Gogoi [Raijor Dal chief] refused to have any truck with the Congress, which allied with the AIUDF and other parties in the previous election. Since I was supporting the alliance, I felt it unethical to remain with Akhil Gogoi and resigned. Things have changed a lot since then. This time, I had this notion of an Opposition unity quite early. We had …
