It is anti-constitutional for the Governor to become a parallel power centre. The Chief Minister has still not reacted to this. There is a widespread perception that the government is surrendering to the Sangh Parivar. It appears that the Governor is making use of this situation. In 2024, when the Governor directed the Chief Secretary and the State Police Chief to appear for a meeting, the State government had taken a stand against it,” he said on Thursday (June 18, 2026).  CMO’s statement Later in the evening, the Chief Minister’s Office (CMO) issued a statement as per which the Governor’s Secretary officially informed the Chief Secretary that the officials were not called for a …

New Delhi, A court that protects rights only for those who can afford to litigate is not fulfilling its constitutional function but merely performing it, Chief Justice of India Surya Kant has said. Court protecting rights only for those who can litigate not fulfilling constitutional function: CJI The CJI has also said the judiciary must not only be the guardian of rights, “it must be accessible enough for that guardianship to be real”. Rajya Sabha defections, constitutional questions

Rajya Sabha defections, constitutional questions

The recent developments within the Aam Aadmi Party (AAP), appear to have dealt a decisive blow to its representation in the Rajya Sabha. On April 24, 2026, seven out of its 10 sitting Members of Parliament, publicly announced that over two-thirds of the party’s MPs had decided to merge with the Bharatiya Janata Party (BJP), invoking the provisions of the 10th Schedule of the Constitution. While the development has attracted widespread political attention, its implications extend beyond immediate partisan concerns. It raises significant constitutional questions regarding the interpretation of the anti-defection law, particularly the scope of the “merger” exception under the 10th Schedule. Nor is the episode entirely unprecedented. Similar assertions of legislative strength have been witnessed at the State level, most notably in the case of the Eknath Shinde-led faction in the Shiv Sena within the Maharashtra Assembly. However, the present instance assumes greater significance as it unfolds at the national level, involving MPs in the Rajya Sabha, thereby amplifying its constitutional and political consequences. ‘Constitutional morality finally comes down to justice without fear or favour’, Kapil Sibal at Justice Unplugged 2026

‘Constitutional morality finally comes down to justice without fear or favour’, Kapil Sibal at Justice Unplugged 2026

The question of constitutional morality ultimately comes down to justice without fear or favour, senior advocate Kapil Sibal said on Saturday (February 28, 2026). “The problem with our court today is that there is a breakdown of our constitutional machinery, complete breakdown,” Mr. Sibal said in a free-wheeling conversation with N. Ram, Director of The Hindu Group, at The Hindu Justice Unplugged 2026, as they discussed the erosion of constitutional morality and if public faith in the court is eroding. Edited excerpts: Constitutional morality is a powerful but apparently elusive and shape-shifting concept. It has absorbed a variety of meanings over different historical and socio-political settings and circumstances across time. In the 19th Century, George Grote used the term to convey the simple but potent idea that a Constitution survives by habits, not merely by text. Speaking in the Constituent Assembly on November 4, 1948, Dr. B.R. Ambedkar, Chairman of the Drafting Committee, invoked Grote’s idea and term, which might have carried a strange ring to several members of our Constituent Assembly. Over the next 78 years, …
