Actor Preity Zinta secured a major legal victory at the Bombay High Court on Wednesday, as the court ordered the removal of all deepfakes, morphed images, fake videos, and other unauthorised online content featuring her. The court held that the misuse of such content infringes on a person’s fundamental rights. Preity Zinta has secured a major legal victory concerning her personality rights. Preity Zinta gets relief from Bombay HC On Wednesday, a single-judge bench of Justice Madhav Jamdar not only gave relief to Preity but also reminded online platforms of their due diligence obligations under the Information Technology Rules. The court also raised the issue of intermediaries’ role in tackling such content, as even their platforms were being misused. “If the intermediaries start taking action, such type of offenders will stop. Otherwise, you are part of affecting fundamental rights of the citizens of this country,” the HC said. Bollywood actor and IPL franchise co-owner Preity Zinta has now taken the legal route, approaching the Bombay High Court over alleged deepfakes, morphed images and other unauthorised digital content that she says uses her identity without permission. The plea states that AI-generated deepfake videos, morphed images and chatbot-style conversations using her likeness have been circulating on platforms such as YouTube, Instagram and Facebook without her knowledge or consent. Appearing for the actor, senior advocate Venkatesh Dhond told the court that advances in AI have made deepfakes far more convincing than before, making it increasingly difficult for viewers to distinguish fake content from real content. The suit, which was heard on Friday, alleges widespread and systematic unauthorised exploitation of Naga Chaitanya’s personality rights by various entities through pornographic websites, AI-generated content, deepfake videos, defamatory material, and unauthorised commercial use of his identity. The court was specifically shown instances of websites pairing the actor’s name with explicit search terms to drive traffic, as well as unauthorised merchandise listings carrying his likeness. The suit also flagged manipulated content and allegedly defamatory material related to his personal life that has been circulating online. The suit states that cease-and-desist notices and legal complaints had already been issued to several intermediaries, online platforms and service providers. Acting on a plea of Aman Gupta, Justice Tushar Rao Gedela noted that the defendants were exploiting his persona and slogans for “unlawful financial gains”, resulting in unjust enrichment. “The material placed on record, as also the averments describing the personality traits and other attributes of the plaintiff, demonstrate that the plaintiff, in a short span of his career, has achieved certain milestones which have entrenched him in the business and industry circles in India, as also exposed him to certain significant international forums,” the court said in its May 7 order.
