New CJI Surya Kant disallows oral mentions, takes up 17 cases on day one

On the first day as the CJI, Justice Surya Kant on Monday set a new procedural norm that mentioning cases for urgent listing must be made in writing, and oral requests will be entertained under “extraordinary circumstances” like in cases of death penalty and personal liberty. A bench led by Justice Kant heard 17 cases in proceedings spanning around two hours on his first day as the Chief Justice of India (CJI). Justice Kant formally assumed charge as the 53rd CJI shortly after taking oath in Hindi in the name of God at the Rashtrapati Bhavan. Arriving at the Supreme Court for the first time as CJI in the forenoon, he paid floral tributes at the statues of Mahatma Gandhi and Dr B R Ambedkar on the court premises. He then presided over a three-judge bench, also comprising Justices Joymalya Bagchi and Atul S Chandurkar, in the heritage courtroom number one. Shamseer sternly declined to entertain the Opposition’s adjournment notice seeking the leave of the House to debate a Serious Fraud Investigation Office (SFIO) enquiry against the now-dormant IT company owned by Chief Minister Pinarayi Vijayan’s daughter, T. Veena. Mr. Shamseer’s stringent ruling that Rule 53 of the Kerala Assembly’s Rules of Procedure and Conduct of Business precluded any discussion on a subject under the consideration of the judiciary or a statutory body with investigative powers drew a vociferous protest from the UDF. Opposition members raised banners accusing Mr. Vijayan of corruption and nepotism. Mr. Shamseer also cut off Leader of the Opposition V.D. Satheesan from making a case for an adjournment debate. A division bench of Justices RD Dhanuka and Milind Sathaye is hearing petitions challenging two orders of the Maharashtra government, one of September 15 cancelling the license and the second of September 20 ordering an immediate stop to manufacture and sale of the company’s baby powder product. As the matter was called out on Friday, advocate Venkatesh Dhond, appearing for the company, submitted the license of the company has expired and that they needed limited protection between today and Monday. “I don’t want anyone saying your license has expired so you stop manufacturing,” he added.
