(Getty Images/iStockphoto) A bench of justices C Hari Shankar and Om Prakash Shukla ruled that no mandamus can be issued for enforcing a statement made at a press conference. “The prayer in the writ petition for direction to implement the assurance made in the press conference dated March 29, 2020, of the chief minister is misconceived and is accordingly rejected,” the court said. “We, however, reiterate our clear opinion that no mandamus can be issued to enforce the statement made by the chief minister in the press conference…” A detailed copy of the verdict was awaited. The Delhi government appealed against Justice Prathiba M Singh’s July 2021 order directing it to decide within six weeks on the then chief minister Arvind Kejriwal’s announcement of paying the rent of poor tenants unable to do so due to the Covid-19 pandemic. …

Supreme Court to pass enforceable orders on Delhi-NCR air pollution

Supreme Court to pass enforceable orders on Delhi-NCR air pollution

The Supreme Court on Monday said that it will pass effective orders that are enforceable in matters relating to the worsening air pollution in Delhi-National Capital Region (NCR), news agency ANI reported. A bench of Chief Justice of India Surya Kant and Justices Joymalya Bagchi and Vipul M Pancholi said that it will hear the matter of the air pollution crisis in Delhi-NCR on Wednesday. Senior advocate Aprajita Singh, who is assisting the court as an amicus curiae, presented the matter before the bench, stating, “Though the preventive measures are in place, their poor implementation by the authorities was the key issue.” “Until this court directs something, the authorities do not comply with the protocols which are already there,” she added.  The senior advocate further said, “The states will not take action till the court orders… Last month an order was passed that sport events will not happen in December-January. Despite these orders having been passed for such activities, they have found ways and means to bypass the order.” After listening to the petition, the …

A Missouri judge says the state’s abortion ban isn’t enforceable, ensuring legal abortions | News Today News

A judge ruled Friday that Missouri’s near-total abortion ban is unenforceable under a new constitutional amendment, ensuring abortion will be legal in the state. Jackson County Circuit Court Judge Jerri Zhang issued an order blocking the state’s strict abortion law after a new abortion-rights constitutional amendment recently took effect. Missouri is one of five states where voters approved ballot measures in the 2024 general election to add the right to an abortion to their state constitutions. The Missouri amendment does not specifically override any laws. Instead, advocates must ask courts to knock down bans they believe are now unconstitutional. Zhang’s order is temporary, but it signals that she’s likely to find the ban unconstitutional after the lawsuit that abortion-rights supporters filed plays out. Spokespeople for Planned Parenthood, the American Civil Liberties Union of Missouri and Missouri Attorney General Andrew Bailey did not immediately respond to messages seeking comment Friday. Bailey, an abortion opponent, issued an opinion agreeing that most abortions would be legal when the amendment took effect. But Bailey’s office is still fighting for …

US and UK sign legally enforceable AI treaty

The US, UK, and European Union have signed the first “legally binding” treaty on AI, which is supposed to ensure its use aligns with “human rights, democracy and the rule of law,” according to the Council of Europe. The treaty, called the Framework Convention on Artificial Intelligence, lays out key principles AI systems must follow, such as protecting user data, respecting the law, and keeping practices transparent. Each country that signs the treaty must “adopt or maintain appropriate legislative, administrative or other measures” that reflect the framework. Andorra, Georgia, Iceland, Norway, the Republic of Moldova, San Marino, and Israel also signed the framework, which has been in the works since 2019. Over the past several months, we’ve seen a swath of other AI safety agreements emerge — but the majority don’t have consequences for the signatories who break their commitments. Even though this new treaty is supposed to be “legally binding,” the Financial Times points out that “compliance is measured primarily through monitoring, which is a relatively weak form of enforcement.” “We must ensure that the rise …
