A bench of president Dr Gudla Tanuja and member Varri Krishna Murthy were hearing the complaint filed by 53-year-old Savara Bhaskar, who sought directions to the insurance company to pay the sum assured of Rs 50 lakh and Rs 1 lakh as compensation for mental agony. “The opposite parties (HDFC Insurance), having issued a policy based on the proposal receiving the premium amount, cannot disown their liability after the risk invoking the exclusionary clauses. Hence, the Commission is constrained to hold that the opposite parties miserably failed in discharging the burden in proving the defence and the acts of the opposite parties in cancelling the policy after risk without any justifiable ground tantamount to deficiency in service,” the May 30 order read. ‘Insurer can’t disown liability’ The commission held that the …

The Pethkar family reportedly purchased a group accident insurance policy in the name of the local gram panchayat after submitting the village voters’ list, ensuring that all residents were included without paperwork or individual enrollment. Consumer news: Nearly three decades after a Jaipur businessman died in a road accident, the National Consumer Disputes Redressal Commission (NCDRC) has reaffirmed its earlier direction, awarding Rs 10 crore with 9 per cent annual interest to his family, holding that the insurer failed to justify the rejection of a high-value personal accident insurance claim. The national consumer commission declared the insurer’s rejection letter “untenable” and held that the company could not substantiate allegations of suppression of material facts because it failed to produce the original proposal forms forming the basis of the dispute. A bench of Justice A P Shahi, President and Bharat Kumar Pandya, Member, was hearing two connected complaints filed by a widow, one Asha Garg and her family, against United India Insurance, over the rejection of personal accident insurance policies issued to the deceased businessman. “We are therefore in agreement with the ultimate conclusion drawn by this Commission in the previous decision dated 24.11.2005,” the national consumer commission said on May 15 affirming its own order. A consumer commission in Nagpur has directed the State Bank of India (SBI) to pay Rs 5 lakh to a widow whose insurance claim was rejected due to a six-year delay in filing. The District Consumer Disputes Redressal Commission (Additional DCF) held that “mental shock” following the sudden death of a spouse is natural and that grieving families may take time to recover before pursuing financial claims, reported PTI. In its order delivered last month, the commission ruled that a bank cannot use the 90-day claim submission deadline as a shield when it has failed to properly inform customers about the insurance benefits attached to their debit cards. Pradeep Ranganathan’s sci-fi comedy drama Love Insurance Kompany (LIK) ended its box office journey on a disappointing note. The Tamil movie wrapped its entire theatrical run with a gross of around Rs. 58 crore at the worldwide box office. Of this, the movie fetched around Rs. 45 crore from the domestic markets, while foreign territories contributed a sum of USD 1.4 million (Rs. 13 crore).  Directed by Vignesh Sivan, Love Insurance Kompany (LIK) collected around Rs. 31.50 crore in Tamil Nadu, which is an underwhelming total.
