Bombay HC extends interim stay on order directing FIR against ex-Sebi chief | Mumbai News

The Bombay High Court on Tuesday extended an interim stay on a special PMLA Court order that had directed filing an FIR against six people, including former Sebi chairperson Madhabi Puri Buch, in a case of alleged stock market fraud and regulatory violations. A single-judge bench of Justice Shivkumar G Dige had on March 4 stayed the March 1 order of a special court designated under the Prevention of Money Laundering Act. The special court had directed the Anti-Corruption Bureau (ACB), Mumbai, to register an FIR based on a complaint by Dombivali resident Sapan Shrivastava, who alleged that he and his family had suffered losses after investing in Cal Refineries. Mumbai: A special court ordered that a case be filed against former SEBI (Securities and Exchange Board of India) chairperson Madhabi Puri Buch and five other officials in connection with alleged stock market fraud and regulatory violations. The court has said it will monitor the probe, and sought a status report (of the case) within 30 days. The SEBI has said it would contest the order, contending that the court was acting on a “frivolous” petition and had not given the board a chance to present its side. “There is prima facie evidence of regulatory lapses and collusion, requiring a fair and impartial probe,” special court judge Shashikant Eknathrao Bangar said in response to the petition filed by  a reporter, Sapan Shrivastava, who sought an investigation. The allegations disclose a cognisable offence, making investigation necessary and the inaction by law enforcement agencies and SEBI “necessitates judicial intervention” the judges said. The Finance Ministry on Monday said the Securities and Exchange Board of India (Sebi) has “adequate internal mechanisms for addressing issues relating to conflict of interest” on the allegations against Sebi Chairperson Madhabi Puri Buch of having investments in an offshore fund used by Adani Group and her continuing position in ICICI Bank. For the complaint by Sebi employees against Buch, the Ministry said employee-related matters are addressed through “appropriate internal mechanisms”. In a written response to a question in Lok Sabha, Minister of State for Finance Pankaj Chaudhary said the Sebi Board has adopted a “Code on Conflict of interests for its board members, including the Chairperson, to ensure that the Board conducts itself in a manner that does not compromise its ability to accomplish its mandate or undermine the public confidence in the ability of member(s) to discharge his responsibilities”. “Securities and Exchange Board of India (Sebi) has adequate internal mechanisms for addressing issues relating to conflict of interest, which include a disclosure framework and provisions for recusal,” he said.
