A two-member Bench consisting of Justice Sushrut Arvind Dharmadhikari and Justice V. M. Shyamkumar had passed the judgment last month in a writ petition filed by the State government challenging a Single Judge’s order striking down the appointment of an inquiry commission into the Munambam issue. The KWB will argue that an error was apparent on the face of the judgment, and the Bench exceeded its judicial mandate by passing the order on an issue that was never raised by the appellants or any other parties to the litigation, sources said. The State government, the appellant in the case, had challenged the Single Judge’s order cancelling the appointment of C.N. Ramachandran Nair as the Commission of Inquiry. Reconstitution of Waqf Tribunal and Waqf Board will help Munambam residents, says Minister Kiran Rijiju

The recent amendments to the Waqf Act that enabled the reconstitution of the Waqf Tribunal and the Waqf Board will help the residents of Munambam in their legal fight to restore the revenue rights of their holdings. The residents can move the Supreme Court against the orders of the High Court in Waqf cases, according to Kiran Rijiju, the Union Minister for Minority Affairs. Speaking to mediapersons here on Tuesday (April 15, 2025), Mr. Rijiju hinted that the residents of Munambam may have to take legal recourse for addressing the vexing issue as the matter was pending before judicial fora. The newly constituted Waqf Board and the changes to be introduced in the tribunal’s structure may ultimately benefit the residents. Since the matter is pending before the judicial fora, one cannot resort to any shortcuts to address the concerns, he said. Munambam: Waqf Tribunal questions validity of Board’s claim over land

The Waqf Tribunal has questioned the validity of the Kerala Waqf Board’s claim on the Munambam land on the ground that the said land was not registered as Waqf property when the Farook College carried out its sale. In Friday’s hearing, the Tribunal chairman pointed out that there could not be any issue with the sale of the property as it was not registered as Waqf when the sale happened. It was in the 1950s that the property deeds hinting that the said land belonged to the Waqf emerged. The Waqf Act of 1954 states that if a piece of land was discovered to be Waqf property, it has to be registered within three months. Only such a registration gives the Waqf Board power to intervene in matters of the said property. However, the land in question at Munambam was not registered as Waqf property even after the Act came into effect. Instead the registration procedure began only in 2019. Instead, it has taken a new course following recent judicial intervention on the issue. The Kerala State Waqf Board had recently included the disputed land in Munambam coast in Ernakulam, which is inhabited by about 600 families, most of them Christians, in the Waqf register as a Waqf property. The occupants of the land in Munambam have been protesting for more than 150 days demanding that the revenue rights of their holdings be restored. They claim to have purchased the holdings from a trust, for which the property was reportedly given as Waqf in 1950. The protest, which is spearheaded by the Assembly of Christian Trust Services, is supported by Sangh Parivar outfits and some Hindu community organisations. A meeting of religious scholars in Kochi, Kerala, on Monday (December 16, 2024) slammed what they called “baseless allegations” against the Waqf law involving the move by the Central government to amend the Waqf Act.
