‘Secret proceedings’ delay fugitive Nirav Modi’s extradition from UK to India again

‘Secret proceedings’ delay fugitive Nirav Modi’s extradition from UK to India again

Fugitive diamantaire Nirav Modi’s extradition to India may be on hold because of a second asylum claim by him, HT learns. UK tells India Nirav Modi cannot be extradited yet over ‘secret proceedings’ (File photo) New Delhi has won in all extradition proceedings concerning Modi in UK courts, but his repatriation appears to have hit a roadblock, with British authorities informing their Indian counterparts that he cannot yet be extradited due to certain “secret proceedings”, highly placed officials told HT. London has neither officially nor unofficially shared with New Delhi the nature of these “secret proceedings”, but this is generally the term used for a plea for asylum. Modi made an earlier asylum plea in 2018, but this was rejected last year. But Indian officials aren’t ruling out the possibility of Modi making a fresh asylum claim in the UK on humanitarian grounds — particularly by citing the Sanjay Bhandari case and arguing that there has been a significant change in the circumstances since his previous application. Over the past year, Modi unsuccessfully argued before …

UK court leans on India’s assurances, denies Nirav Modi fresh shot at extradition| India News

A UK court on Wednesday rejected fugitive diamantaire Nirav Modi’s bid to reopen his extradition proceedings, upholding earlier rulings and accepting assurances by the Indian government that he would not be interrogated by investigating agencies if extradited. (Mint File Photo) In an 18-page judgment reviewed by HT, the high court of justice in London bench of Lord Justice Jeremy Stuart-Smith and Justice Robert Jay held that the circumstances to reopen the case were “not exceptional”. The judges accepted India’s assurances, describing them as “specific and not general and vague”, and said they had been given “in good faith and with the intention that they should be binding”. Following the decision, the Central Bureau of Investigation (CBI) said Modi’s challenge had been “successfully overcome” through sustained and coordinated efforts. It added that the matter was “strongly argued by the Crown Prosecution Service (CPS) advocate (Helen Malcolm)”, “ably assisted by a dedicated team of CBI, including investigating officers who travelled to London for the hearing (last week)”. What was Nirav Modi’s appeal? In …

London High Court rejects Nirav Modi’s “reopen” petition against extradition

Nirav Modi. | Photo Credit: ANI The London High Court has rejected the petition of diamond merchant Nirav Modi to reopen proceedings against his extradition order, in connection with the Punjab National Bank (PNB) fraud case, according to the Central Bureau of Investigation (CBI). “Nirav Modi’s petition to reopen proceedings against his extradition order by U.K. courts was rejected today by the High Court of Justice, King’s Bench Division, London,” said the agency. “The matter was strongly argued by the Crown Prosecution Service advocate, ably assisted by a dedicated CBI team, including investigating officers who travelled to London for the hearing. The reopening application had been filed on the basis of the Bhandari judgment,” it said. The High Court, while handing down the judgment, observed that the reopen petition and the circumstances surrounding it are not exceptional so as to make it appropriate to re-open it. The CBI has been seeking the extradition of Mr. Modi, with proceedings ongoing since 2018. Following his arrest in the U.K. in 2019, courts approved his extradition and rejected …

UK court rejects Nirav Modi’s plea to reopen extradition case; clears way for fugitive diamantaire’s India return| India News

The High Court of Justice in London on Wednesday refused to reopen fugitive diamantaire Nirav Modi’s extradition case, in a verdict that appears to exhaust his last legal avenue in the United Kingdom and potentially clearing the path for his return to India after more than seven years in British custody. The CBI, which has been pursuing Modi’s extradition since 2018, said its investigating officers had travelled to London. (Mint Print) The ruling hinged on assurances from the Indian government — delivered in September 2025, December 2025, and through a note verbale from the Indian High Commission in London in February 2026 — that Modi will not be interrogated by any of the five investigating agencies handling his cases. The assurances proved crucial — Modi had sought to reopen his extradition by citing the case of defence consultant Sanjay Bhandari, whose extradition was blocked by a UK court last year on human rights grounds, arguing that the same risk of torture applied to him. Without the government’s pledges, the court said, it would have been …

(File pic: PTI) A London court has agreed to defer proceedings in an unpaid loan case against fugitive diamantaire Nirav Modi, allowing his request to postpone the trial until March next year due to delays by UK prison authorities in providing him access to key legal documents. Nirav Modi, 54, who is wanted in India on charges of fraud and money laundering in the Rs 13,000-crore Punjab National Bank (PNB) scam, is facing a separate civil case in the UK linked to an $8 million loan extended by the Bank of India. He has been contesting his extradition to India while lodged in British custody since March 2019. During an online review hearing on Friday, Justice Simon Tinkler partly accepted Modi’s …

London court puts off first hearing on Nirav Modi’s plea to reopen extradition case

London court puts off first hearing on Nirav Modi’s plea to reopen extradition case

NEW DELHI: The first hearing on fugitive diamantaire Nirav Modi’s appeal against his extradition to India, scheduled for Tuesday in London, has been postponed until the end of February 2026, people familiar with the development said. Nirav Modi (FILE) Officials said the hearing was postponed because Nirav Modi’s legal team requested time to submit certain documents. A Central Bureau of Investigation (CBI) and Enforcement Directorate (ED) team travelled to London for Tuesday’s hearing and is understood to have met with Crown Prosecution Service (CPS) lawyers, who will argue the case before the UK court on behalf of India. As first reported by HT, a Westminster court admitted Modi’s plea to reopen his extradition case in August. He had alleged that, if extradited, he would be interrogated by multiple agencies and may face torture during such interrogation. The Indian government has already sent a letter of assurance to London – a sovereign guarantee of sorts – stating that the fugitive diamantaire, in the event of extradition, “will only face trial” in India and “won’t be interrogated …

Showers, western-style toilets: Tihar preps barracks for fugitive economic offenders | Delhi News

Bathing showers, Western-style toilets, wash basins and tiled bathrooms. Two special barracks inside Delhi’s Tihar Jail have been upgraded with a slew of facilities to accommodate “around 20” fugitive economic offenders. The upgrade comes after a team from the UK’s Crown Prosecution Service (CPS) visited Tihar to assess the condition of inmates as well as security within the prison premises in July. The visit came in the backdrop of the Government’s efforts to secure the extradition of fugitive economic offenders such as liquor baron Vijay Mallya, diamond trader Nirav Modi, and UK-based arms consultant Sanjay Bhandari. British courts had recently pointed to concerns over the condition of prisons in India while hearing the extradition cases. According to Tihar Jail sources, the two special barracks, each with a capacity to accommodate 10 inmates, are inside Jail No. 7 — a dedicated facility for white-collar criminals. “These barracks are equipped with windows for ventilation and surrounded by greenery. Keeping their security in view, the barracks have been set up separately from the other prisoners in the jail,” …

What UK Judge Said On Denying Fugitive Diamond Trader Bail For 10th Time

What UK Judge Said On Denying Fugitive Diamond Trader Bail For 10th Time

London: Dismissing the 10th bail plea of Nirav Modi after considering that the fugitive diamond trader would ‘abscond’ if released, the London High Court judge has said UK courts have “twice concluded that there is an evidenced prima facie case against the applicant.” Stating that his risk of absconding is high, Justice Michael Fordham at the Royal Courts of Justice dismissed the bail plea. “And I repeat, after careful evaluation, UK courts have twice concluded that there is an evidenced prima facie case against the applicant,” Justice Fordham said while rejecting Nirav Modi’s bail plea on May 15. The 54-year-old fugitive has filed the bail application after his extradition to India was allowed by a UK Court earlier. His bail application was opposed by the Indian agencies before the High Court. It was his 10th bail petition since his detention in the United Kingdom in 2019. Nirav Modi, the prime accused in the over Rs 13,800 crore fraud at Punjab National Bank, was declared a fugitive economic offender by India in December 2019. The UK …

In London court, ED flags Nirav Modi role in evidence destruction | India News

OBJECTING TO the bail application of diamond merchant Nirav Modi, the Enforcement Directorate alleged in a London High Court that he was criminally responsible for actions in which witnesses were interfered with and evidence was destroyed. Modi’s bail application was rejected by the High Court of Justice, King’s Bench Division in London last week, with the judge saying that there were substantial grounds for believing that if released on bail, he would fail to surrender and his “risk of absconding remained high”. This was the tenth time Modi had applied for bail since his detention in the extradition case to India to face charges in the Punjab National Bank (PNB) fraud and money laundering scam amounting to Rs 6,498 crore. Story continues below this ad In his order, passed on May 15 at the Royal Courts of Justice, Justice Michael Fordham said, “I want to return to the question of the underlying allegations to identify one part of the case against the applicant in the Indian criminal proceedings. Part of what is alleged is that …

UK Judge Notes “Confidential Impediment” In Nirav Modi Extradition Case

UK Judge Notes “Confidential Impediment” In Nirav Modi Extradition Case

London: A London High Court judge who refused Nirav Modi’s latest bail application this week has taken note in his judgment of a “confidential impediment” in the long-drawn extradition proceedings against the imprisoned diamantaire wanted in India on fraud and money laundering charges. Justice Michael Fordham on Thursday concluded at a Royal Courts of Justice bail hearing that there are substantial grounds for believing that if released on bail, the 54-year-old businessman would “fail to surrender” and his risk of absconding remained high. While Nirav’s barrister argued in favour of his bail from London’s Thameside prison based on the “long passage of time” without trial, the judge highlighted the constraints of a “confidential” process that prevented his surrender to the Indian authorities even though the legal process related to his extradition had “run its course”. “There is a ‘legal reason’ which relates to ‘confidential proceedings’. The nature of this is known to the applicant (Nirav Modi), and his lawyers; it is known to the Home Office, but apart from what I have recorded, nothing is …
