NAVI MUMBAI: A repeat narcotics offender has been detained under the Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances (PIT NDPS) Act and sent to Yerwada Central Jail, Pune, for one year. Repeat NDPS offender detained Police said the detention is only the second such case in Maharashtra under the PIT NDPS Act and forms part of the commissionerate’s crackdown on repeat drug offenders under the “Nasha Mukt Bharat 2028” campaign. The accused, identified as Rajan Bala Rathod, a resident of Annabhau Sathe Nagar in Mankhurd, allegedly travelled from Mumbai to Navi Mumbai to sell narcotic substances. Police said Rathod has four cases registered against him under the NDPS Act in Mumbai and Navi Mumbai. He also faces five criminal cases under provisions of the Bharatiya Nyaya Sanhita and the Indian Penal Code, including attempt to murder, assault and robbery, police said. Officials said Rathod allegedly continued his involvement in narcotics trafficking despite repeated action against him. According to a PTI report citing police officials, a 40-year-old man with a criminal background was arrested for the theft, and valuables worth Rs 1.37 crore were recovered. The accused has been identified as Manoj Mohan Rathod, a resident of Palghar district, who was found to have a long history of similar crimes. Police investigations revealed that Rathod was allegedly involved in at least 14 other theft cases registered across Mumbai and nearby regions. Prayagraj , The Allahabad High Court has observed that the issuance of a proclamation under Section 82 of the Criminal Procedure Code , whereby an accused is declared an absconder, does not create a total embargo on considering his/her application for anticipatory bail. No total embargo on grant of anticipatory bail even if accused is proclaimed offender: Allahabad HC Justice Gautam Chowdhary allowed the anticipatory bail application of one Monika noting that the applicant was “in family way” and had actually given birth to a child just days before a non-bailable warrant was issued against her. “It is not as if in all cases that there will be a total embargo on considering the application for grant of anticipatory bail. In the present case at the time when certain processes were issued against the applicant, she was in family way and was unable to appear before the court concerned, this Court finds it a fit case for grant of anticipatory bail,” Justice Chowdhary said in an order passed on Tuesday. Telephone tapping case: Prabhakar Rao will be proclaimed offender if he fails to appear before court by June 20

A local court here might announce T. Prabhakar Rao, the absconding accused in telephone tapping case, as proclaimed offender if he does not appear before the court by June 20.  The Fourteenth Additional Chief Judicial Magistrate passed a direction to this extent. Retired IPS officer and former chief of Special Intelligence Branch, Mr. Rao held several key positions in police department. According to police department, he ‘fled the country’ on learning that the telephone tapping case was registered. However, Mr. Rao in his communication to the police department in the affidavits he had filed in the courts maintained that he had gone to U.S. for medical treatment for serious ailment and was ready to cooperate with the investigators. The Telangana High Court had rejected his anticipatory bail petition following which he had moved the Supreme Court.  In January, the investigators filed a petition in the trial court requesting it to declare Mr. Rao as a proclaimed offender under Section 82 of Criminal Procedure Code. These include Gujarat, Uttar Pradesh, Delhi, Goa, Rajasthan, Punjab, Himachal Pradesh, Jammu and Kashmir, Karnataka and Telangana, among others. While States such as Punjab, Andhra Pradesh, and Telangana have said that the law is practically redundant and not implemented, the Gujarat government has claimed that its law “does not intend to” harass or harm any community and has hence opined against its repeal.
