‘Onus of proof on petitioner’: Calcutta High Court denies relief to Bangladeshi Hindu woman overstaying in India | Legal News

6 min readNew DelhiMay 7, 2026 04:54 PM IST Calcutta High Court news: The Calcutta High Court has refused relief to a Bangladeshi Hindu woman accused of overstaying in India without a valid visa, holding that under the Immigration and Foreigners Act, 2025, the onus is on her to confirm her right to stay in India. Justice Ajoy Kumar Mukherjee was hearing the woman’s plea seeking to quash the proceedings against her under Section 21 (penalty for entry without a valid passport or other travel document) of the Immigration and Foreigners Act. The woman alleged that the investigating officer falsely implicated her at the behest of her husband. “This provision is a corner-stone of the Act of 2025, designed to strengthen national security, streamline immigration and enables authorities to take action, such as deportation, if the individual fails to establish their no foreign status. Therefore, the onus to provide documentation, confirming citizenship or right to stay/overstay in India lies upon the questioned person/petitioner, shifting the burden away from the state,” the May 6 order of …

‘Onus Is On IndiGo’: Govt Sources On Iltija Mufti’s Claim Of Muslim Staff Being Abused | India News

Last Updated:December 22, 2025, 23:46 IST According to government sources, IndiGo would need to formally complain about the passenger for further action to be taken. Iltija Mufti | File Image Government sources on Monday told CNN-News18 that the responsibility for initiating action in the case highlighted by Iltija Mufti, involving the alleged verbal abuse of a Muslim IndiGo ground staff member by a passenger, rests primarily with the airline, not the aviation ministry or the regulator. According to government sources, IndiGo would need to formally complain about the passenger for further action to be taken. Under existing aviation rules, an unruly passenger can be placed on a no-fly list once the airline completes due process. After that, the airline may share the details with other carriers, enabling wider enforcement of the restriction. Sources clarified that the Ministry of Civil Aviation and the Directorate General of Civil Aviation (DGCA) have a limited role in such cases unless the airline initiates formal proceedings. “The onus is on IndiGo to take the next steps as per established procedures,” …

OPINION | Onus of extending ceasefire rests on Pakistan, not India

OPINION | Onus of extending ceasefire rests on Pakistan, not India

India has carefully explained this to Pakistan, and to the US too. So, the onus on whether to continue the ceasefire or not, is not on India, but on Pakistan. If Pakistan carries out any fresh mischief, our BrahMos missiles will finish off the remaining air bases in Pakistan. New Delhi: The question that is being asked almost everywhere is: Will the ceasefire hold or will there be another conflagration? Pakistan’s Deputy PM and Foreign Minister Ishaq Dar told the Upper House of his Parliament that the ceasefire with India would continue till May 18. He sounded optimistic that the deadline for ceasefire would extend, step by step. Dar said, “During the DGMOs’ conversation, the ceasefire was extended until May 12. When the DGMOs spoke again on May 12, the ceasefire was extended until May 14. Further talks on May 14 led to the ceasefire being extended until May 18.”  On Friday, Defence Minister Rajnath Singh poured cold water on Pakistan’s hopes. At Bhuj air base in Gujarat, Singh said, “Operation Sindoor is not yet …

Story continues below this ad “In a sense, it puts more pressure on them because whoever is going to play them in the semi or potentially the final is going to go there and the conditions are going to be foreign but they [India] are going to be used …
