While setting aside an order that denied permission for a Bangladeshi woman to donate a kidney to her minor son, the Madras High Court said that “a mother’s claim to her child should not be casually doubted”. The court directed the committee to immediately grant approval for the transplant. (File picture | Representative) In an order passed last week, Justice GR Swaminathan of the Madras High Court found fault with the approach adopted by the Tamil Nadu Authorisation Committee, which regulates living donor organ transplants to prevent commercial dealings. The committee had rejected a Bangladeshi family’s application for a kidney transplant after concluding that the marital relationship between the child’s parents had not been established. Justice Swaminathan said that one must keep in mind the special significance that is attached to the mother-child relationship, and that authorities should not casually disbelieve a woman’s claim that she is a child’s mother. The organ retrieval was carried out at the Trauma and Emergency Care Centre (TECC) on the State-run Victoria Hospital campus, attached to the Bengaluru Medical College and Research Institute (BMCRI). While the retrieval procedure was undertaken at the trauma centre, the organs were subsequently allocated for transplantation to eligible recipients as per protocol. More than half of them – 19 – were from government hospitals, the majority situated outside Chennai. “This is the highest-ever number of donations in one month. This year, till today (February 12), 42 donations have taken place in 43 days – at a rate of one donation a day in Tamil Nadu. The 42nd donation is under way at the Government Kilpauk Medical College (KMC) Hospital,” N. Gopalakrishnan, member secretary, Transplant Authority of Tamil Nadu (TRANSTAN), said. Significantly, the maximum contributor to these 33 donations was a peripheral medical college hospital – Government Dharmapuri Medical College Hospital – which functions as a Non-Transplant Organ Retrieval Centre (NTORC). Whereas in 2024, 181 organs were transplanted from a pool of 70 donors in Pune, officials said. Centre sets timeline for disposing living donor transplant applications

Representational file image. | Photo Credit: Special Arrangement The Union Government has set a timeline of six to eight weeks for health authorities in the States/Union Territories to decide on applications seeking living donor organ transplantation. The decision follows a Delhi High Court order in January, which directed the Ministry of Health & Family Welfare to prescribe timelines for steps in the process of considering an application pertaining to living donor transplantation by the authorisation committee. Notifying the timelines, the Ministry requested Health Secretaries of States/UTs to follow the guidelines as it would immensely help in expediting the decision-making process.
