Court To BJP MP Pragya Thakur In Malegoan Blast Case

Mumbai: A special court in Mumbai on Saturday allowed BJP MP Pragya Thakur’s plea for exemption from personal appearance in the Malegaon blast case on medical grounds but said “necessary order” will be passed if she fails to appear before it on April 25. Six people were killed and over 100 injured when an explosive device strapped on a motorcycle went off near a mosque in Malegaon, some 200 kilometres from here, on September 29, 2008. On April 8, relying on a compliance report submitted by National Investigation Agency on Thakur’s medical condition, Special NIA Judge A K Lahoti granted her exemption from personal appearance but had asked the Bhopal Lok Sabha MP to remain present “without fail” before the court on April 20. However, when the court’s proceedings began on Saturday, Thakur moved an application through her lawyer for exemption from personal appearance claiming she was was facing a critical medical condition. Malegaon blast case: BJP MP Pragya Thakur ill, advised bed rest, says NIA

BJP MP Pragya Singh Thakur, an accused in the 2008 Malegaon blast case, is unwell and doctors have advised her bed rest, the National Investigation Agency (NIA) stated in a compliance report submitted in a special court on Monday. After taking note of the report, special NIA judge AK Lahoti allowed Thakur`s plea for exemption from personal appearance for the day (Monday). The Member of Parliament from Bhopal, a prime accused in the case, had sought exemption from appearance citing health problems, and the court had asked the central agency to verify her health condition and submit a report by Monday. The court, however, directed Thakur to remain present on April 20 and onwards to record her statement without fail. The court is recording statements of the accused under section 313 (where the accused personally explains any circumstances appearing in the evidence against him) of the Criminal Procedure Code (CrPC). The medical certificate annexed with the compliance report states that a doctor visited Thakur`s house in Bhopal, verified her health, and advised her to rest …

A special court on Wednesday observed that BJP MP Pragya Singh Thakur`s absence in the September 2008 Malegaon blast case trial was hampering the proceedings, and asked the NIA to submit a report on her health. The court passed the order after the Member of Parliament from Bhopal, a prime accused in the case, sought another exemption from appearance citing health problems. A K Lahoti, special judge for National Investigation Agency cases, asked the central agency to verify her health condition and submit a report by April 8. The court had on March 11 issued a bailable warrant against the Bhopal MP for failing to attend the proceedings despite being specifically directed. The warrant was cancelled on March 22 after Thakur appeared before the court. But she failed to appear after that. While granting her exemption on March 28, the court had directed Thakur to appear on April 3, warning that a non-bailable warrant would be issued against her otherwise.
