Conflict of interest: Can UP govt advocates represent pvt individuals against state, queries HC

The Lucknow bench of the Allahabad high court has directed the Uttar Pradesh government to clarify a critical legal boundary: can lawyers paid by the state to defend it, also represent private citizens in lawsuits filed against the government? For representation only (HT File Photo) Justice Saurabh Lavania raised the question on May 8 during the hearing of a contempt petition. The court sought a definitive response from the state’s Legal Remembrancer (LR) —the state’s top legal advisory officer—on whether additional government advocates or standing counsel who receive a retainership from the state are permitted to institute proceedings against government authorities or their officers. The issue surfaced while hearing a case moved by Ashok Kumar Singh and 28 other persons. The group alleged that government officials committed “wilful disobedience” regarding a court order issued in 2025. During the proceedings, the court observed that the advocate representing the petitioners, Sudhir Kumar Mishra, is currently serving as an AGA. This dual role—acting as a state prosecutor while simultaneously representing private parties against the state—prompted the bench to …

Budget aims to accelerate growth, boost pvt sector investments, says FM Nirmala Sitharaman | India News

Finance Minister Nirmala Sitharaman on Thursday dismissed the Opposition’s claims of the Union Budget favouring only NDA-ruled states as “unfounded”. Replying to the debate on the budget in Rajya Sabha, the minister said the budget came at a time when “external challenges” were severe, talk of globalisation was accompanied by “fragmentation in the world”, and “free market” beliefs accompanied increasing tariff barriers. Garib (poor), youth, annadata (farmers) and naari (women) were four crucial groups taken into consideration while drafting the budget, Sitharaman said. Story continues below this ad She said the government has kept the goals of accelerating growth and encouraging private investment. Sitharaman also countered the Opposition’s charge that the budget focused only on boosting consumption and neglected capital expenditure. Effective capex, said the minister, includes core capital outlays in the budget and grants-in-aid for the creation of capital assets in the states. “So, though grants-in-aid are accounted as revenue expenditure in the books of the Union government, they go to the states to create capital expenditure. So, they are effectively, eventually, only capital …

The police have arrested the chairman of a private hospital in Gujarat’s Ahmedabad, who evaded arrest for more than two months in connection with the deaths of two PMJAY beneficiaries after botched angioplasty procedures, an official said on Saturday. Kartik Patel, the chairman of Khyati Multispeciality Hospital, was arrested after he landed at the Ahmedabad airport from Dubai late on Friday night, inspector V B Aal of the Ahmedabad crime branch said. With Kartik Patel’s arrest, the police have apprehended all nine …

WB docs from pvt hospitals to join stir on October 14

Doctors of private hospitals on Saturday called for a 48-hour “partial cease work” from October 14 in medical establishments across West Bengal, in solidarity with the agitating junior medics observing a fast-unto-death, demanding justice for the RG Kar hospital victim. The doctors, under the banner of Healthcare Professionals of Private Hospitals, however, said emergency services in all medical facilities will remain operational. Maintaining that the West Bengal government has not taken any positive steps with regard to the demands of the agitating medics of state-run hospitals, the medics said the entire fraternity was worried and in anxiety over the situation. “From October 14 onwards, majority of doctors of private set-ups will not perform any non-emergency duties,” the medics told reporters here. “But, we will make sure no patient suffers due to this, as all emergency services will be kept operational,” they said. The “partial cease work” will begin from 6 am of October 14. The doctors said their agitation could be extended if they do not receive “appropriate response” from the state government. “We request …
