Over 75 pc of RERA authorities failing to publish mandatory reports: FPCE

The Forum For People`s Collective Efforts (FPCE) has claimed that more than 75 per cent of State Real Estate Regulatory Authorities (RERA) across India have failed to publish their legally required annual reports, an official statement said. The findings come shortly after the Chief Justice of India criticised the functioning of RERA authorities. Under the Real Estate (Regulation and Development) Act, 2016, publishing an Annual Report is a statutory obligation under Section 78. However, FPCE’s research states that seven states — Karnataka, Tamil Nadu, West Bengal, Andhra Pradesh, Himachal Pradesh and Goa — have never published a single Annual Report, it said. Nine other states, including Maharashtra, Uttar Pradesh and Telangana, had initially published reports but later stopped doing so. Among the five states that are up to date — Gujarat, Odisha, Madhya Pradesh, Bihar and Jharkhand — none have followed the reporting format prescribed by the Ministry of Housing and Urban Affairs (MoHUA) in February 2023, according to FPCE, the statement said. Eight months after a retired IAS officer from Delhi, Satya Gopal, resigned as chairman of coveted Punjab Real Estate Regulatory Authority (RERA), a retired IRS officer, Rakesh Kumar Goyal, was on Monday appointed the new RERA chief. Goyal was appointed member of RERA in December 2022, when Satya Gopal was appointed the chairman of the authority. However, after the resignation of Satya Gopal, he had proceeded on leave. He had joined back later.Both these retired officials are considered close to Aam Aadmi Party (AAP) supremo Arvind Kejriwal. At the time of their appointment in 2022, the Opposition had taken on the AAP government for appointing Delhi-based officials in Punjab government offices. DDA extends deadline for final payment of flats in Dwarka’s Sector 19B

The Delhi Development Authority (DDA) Tuesday extended the deadline for the final 25 per cent payment for flats in Dwarka’s Sector 19B till October 31. However, if the allottees do not make the remaining payment before the stipulated time, they will have another month to complete their payments but with a 10 per cent interest. The DDA had initially set the deadline for final payments for August 29, but extended it by a month on September 5. The deadline extension comes days after the Real Estate Regulatory Authority (RERA) took up for hearing various complaints related to the quality of flats being constructed. The flats in Sector 19B were the DDA’s first segue into luxury real estate, launched just after Diwali in November last year. The project, which offered 14 penthouses, 170 Super HIG flats and 946 HIG flats via e-auction, saw an enthusiastic response from buyers. However, flat allottees have maintained that the flats are nowhere near completion. Moreover, they complain that the quality of the flats’ construction is well below par for what …

TNREAT chairperson Justice M. Duraiswamy (retired Acting Chief Justice of Madras High Court) and judicial member R. Padmanabhan wrote that builders could not circumvent the provisions of RERA, 2016 by “cleverly” registering individual towers under the Act. The observations were made while dismissing an appeal preferred by Hiranandani Realtors Private Limited against an order passed by the Tamil Nadu Real Estate Regulatory Authority in favour of Hiranandani Amalfi Owners Association on December 21, 2022.
