Supreme Court on Sabarimala: Need to ensure social reform conforms to ‘lakshman rekha’, doesn’t hollow out religion | Legal News

Underlining the need to ensure that social reform measures conform to the “lakshman rekha” set by the legislature and do not hollow out a religion, the Supreme Court on Tuesday said courts may be compelled to interfere if any such reform is thrust upon people against their wish. “If the people of this country, through their elected representatives, raise a common voice that this issue requires social reform, probably the court will accept it as a social reform. But if it is against the wish and will of the people — something is thrust upon them or, as a rule of gagging them, maybe the court will interfere,” Chief Justice of India Surya Kant, presiding over a nine-judge bench, said. Chief Justice of India Surya Kant will preside over the bench, which will include Justices B V Nagarathna, M M Sundresh, Ahsanuddin Amanullah, Aravind Kumar, Augustine George Masih, Prasanna B Varale, R Mahadevan and Joymalya Bagchi. On September 28, 2018, a five-judge bench of the Supreme Court, by a 4:1 majority, lifted the age restriction on women visitors and struck down as unconstitutional Rule 3(b) of the Kerala Hindu Places of Public Worship Rules, 1965, which allowed the exclusion of women on the grounds of custom. The Supreme Court on Saturday formally notified the constitution of a nine-judge bench to hear the long-pending Kerala’s Sabarimala temple review, reviving a constitutional controversy that has remained in cold storage for six years and could reshape the court’s approach to religion-rights conflicts. Nine-judge bench to hear Sabarimala review from April 7, revisiting women’s entry and larger issues of constitutional morality and religious rights. The chemical analysis of gold-cladded sheets at the Sabarimala temple by scientists at the Vikram Sarabhai Space Centre (VSSC) has confirmed a ‘systematic and methodical’ process of gold tampering and substitution, the Kerala high court said on Monday. The court noted that the chemical composition of the gold plates shown in the report was evidence for a systematic and methodical modus operandi employed to execute the theft. (PTI) The bench of Justices Raja Vijaraghavan V and KV Jayakumar, in an interim order, underlined that the apprehensions earlier expressed by the court about misappropriation and pilferage of gold assets from the temple “stand prima facie reinforced.” The court made the observations after studying the technical report at VSSC and submitted by the Special Investigation Team (SIT) investigating the case. Pathanamthitta , The SIT probing the disappearance of gold from the Sabarimala temple on Monday removed several gold-clad plates from just outside the sreekovil for scientific examination, officials said. Sabarimala gold: SIT conducts scientific tests at hill shrine The process, suggested by the Kerala High Court, began at 1.15 pm after the ‘deva anujna’ rituals and the temple’s closure following ‘uchcha puja’. “The procedure continued till 3 pm when the temple was reopened for rituals,” an official said. The team, led by Deputy SP S Sasidharan, the investigation officer, has been stationed at Sabarimala since Sunday for the examination. In addition to police personnel, the Special Investigation Team included 20 members, comprising forensic experts and chemical analysts, officials said. The entire procedure was videographed and photographed. Travancore Devaswom Board sculptors assisted the team in removing the gold-clad plates from the side pillars, the pedestals of the ‘dwarapalaka’ idols, and the door frames of the sreekovil. Sabarimala Ticket Booking: For the information of the devotees, the Travancore Devaswom Board (TDB) opened a virtual queue for Sabarimala pilgrims, setting a daily limit of 70,000 slots. This decision has been taken to ease the rush of devotees during the upcoming pilgrimage season.  As per the updates from the TDB, the virtual queue will be available on the TDB website and app and then the devotees can book their slots in advance and will be given a QR code that they will need to show at the entrance to the temple complex. It is however slightly confusing since the state government had already announced 80,000 daily slots for Sabarimala Temple and this leads devotees to believe that 10,000 slots may be up for grabs through spot bookings. Moreover, the state government has also said that travellers who come without online bookings will also be allowed to have darshan.  This announcement by the Pinarayi Vijayan government comes after it had earlier declared to exclusively …
