Additional Sessions Judge Praveen Singh was hearing the case against 11 accused, including former AAP councillor Tahir Hussain, and deferred the pronouncement of his judgment. The case pertains to an FIR registered at Dayalpur police station on the complaint of Ravinder Kumar, father of Ankit Sharma. According to the complaint, Sharma, who was posted with the Intelligence Bureau, had returned home from office on February 25, 2020, before stepping out again. When he did not return for a long time, his family began searching for him, only to be informed by locals that their son had been killed and his body thrown into the Khajuri Khas drain near a mosque in the Chand Bagh Pulia area. The court said Hussain shall bear all the expenses for his custody parole including for Delhi police officials to be deputed with him and jail van and escort expenses.  The apex court said Hussain shall be released from jail as per the jail manual upon the deposit of the expenses i.e. around 2 lakh for 12 hours. Denying interim bail to former AAP councillor and 2020 Northeast Delhi riots accused Tahir Hussain to campaign for the Delhi Assembly polls, in which he is contesting as an AIMIM candidate, Justice Pankaj Mithal of the Supreme Court has underlined that Indian citizens “deserve…clean politics” and to achieve this, “people with tainted image’ should “be restricted in some way or the other from participating in the election”. On Wednesday, a two-judge SC bench comprising Justices Mithal and Ahsanuddin Amanullah had delibered a split verdict on Hussain’s interim bail plea. While Justice Mithal dismissed it, Justice Amanulla was of the view that the interim relief can be granted. In light of the contrasting opinions, the matter will now be placed before the Chief Justice of India for allocation to a larger three-judge bench. Image Source : PTI Tahir Hussain (Centre) Former AAP politician Tahir Hussain, accused in a murder case related to February 2020 riots and AIMIM leader was on Tuesday granted custodial parole to file a nomination for the upcoming Delhi Assembly elections. Delhi police opposed a plea of Hussain. Saying contesting elections was not a fundamental right, the police alleged Hussain who was the “main conspirator” and “funder” of the February 2020 riots could complete formalities and fight polls on custody parole. Hussain, in the bail plea, said he spent 4.9 years in jail and though the trial started in the case, only 20 of the 114 prosecution witnesses were examined so far. The Delhi High Court instructed that Tahir Hussain will not use his mobile phone, landline phone or internet during nomination. He will also not talk to anyone except officials related to the nomination process. The AIMIM will not even address the media. The Delhi High Court on November 26 quashed and set aside a second FIR lodged at the Khajuri Khas police station regarding the 2020 Delhi riots stemming from the same incident against former Aam Aadmi Party (AAP) councillor Tahir Hussain. The court directed that the chargesheet from the second FIR be treated as a supplementary chargesheet in the first FIR. Two FIRs were lodged stemming from a single incident of riots on February 24, 2020, that occurred in the same premises, except one occurred on the ground floor and the second on the first floor of the building. The first FIR was lodged on February 25 based on a complaint by a constable booking Hussain for the offences of rioting, mischief by fire, and trespassing under the Indian Penal Code (IPC) as well for offences under the provisions of the Prevention of Damage to Public Property Act. Arguing before a Delhi court in the larger conspiracy case linked to the 2020 Northeast Delhi riots, former Aam Aadmi Party (AAP) councillor Tahir Hussain pointed out on Friday that the WhatsApp chats relied upon by the prosecuting agency do not instruct anyone to pick up weapons or indulge in violence. Only ‘chakka jam’ and peaceful protests were mentioned in the chats relied upon by the Delhi Police Special Cell which is investigating the case, the counsel said. The court of Additional Sessions Judge Sameer Bajpai was hearing arguments on framing charges in the case pertaining to the February 2020 riots. “Nowhere in the WhatsApp messages is it mentioned that we should pick up weapons against the Government of India or its agencies,” argued Advocate Rajiv Mohan, representing Hussain. Hussain and 17 others in the case have been charged under stringent provisions of the UAPA. Of the 18 accused arrested in this case, six are on bail and 12 are still in judicial custody.
