Why SC upheld ECI officer transfers in West Bengal polls case

Why SC upheld ECI officer transfers in West Bengal polls case

The Supreme Court on Thursday rejected the challenge to the Calcutta High Court order upholding the Election Commission of India (ECI)’s decision to transfer bureaucrats and police officers in the state in the run-up to the West Bengal Assembly polls. The apex court said it was “compelled” to depute judicial officers for the Special Intensive Revision (SIR) exercise because of the trust deficit existing between the poll body and the state government. Presiding over a three-judge bench, Chief Justice of India Surya Kant also flagged the lack of independence in the bureaucracy and said officials “surrender” for “plum postings”, frustrating the very object of creation of All India Services. “Unfortunately, this is the misfortune of the country, that the very object of creation of All India Services is getting frustrated. Officers are also only for the sake of plum postings, for all personal benefits, they go, and they surrender completely only to secure transfer, postings, etc, to better places. This is how the impression sometimes is created in the minds of the general public that we …

Calcutta HC dismisses PIL challenging transfers of officers by EC in Bengal

The Calcutta High Court on Tuesday dismissed a PIL challenging the transfer of administrative and police officers by the poll panel in West Bengal, stating that the petitioner failed to establish that the actions were arbitrary or had harmed public interest. The Election Commission had transferred several officers, including the state`s chief secretary, the home secretary, and the DGP, following the announcement of the assembly poll schedule in the state. The petitioner claimed that these large-scale transfers would affect the functioning of the state administration and sought to have the poll panel`s orders set aside. Dismissing the petition, a division bench presided over by Chief Justice Sujoy Paul held that the petitioner could not prove that the Election Commission of India had used its power to transfer officers in an arbitrary manner, resulting in any injury to public interest. “In the absence of establishing this elementary requirement to maintain a PIL, the petition cannot be entertained,” the division bench, also comprising Justice Partha Sarathi Sen, said. The court observed, “The legality, validity, and propriety of …

Despite a record £446m spent in summer transfers, why Liverpool are struggling? | Football News

Maybe this was a season Liverpool lost before it had begun. The death of their teammate Diogo Jota would cast its gloom throughout the season, a shuddering loss that they would never recover from or fully cope emotionally. They could talk eloquently about winning the title for him, or him guiding them through this season, but at a practical level, they are all humans with feelings and not hearts of granite. Not a week since his death in a car accident has passed without a reference or an anecdote or a banner about him or a drop of tear being shed on the ground or in the stands or in the dressing room. The unoccupied seat in the dressing room, the retired No. 20 shirt fluttering in the stands, the imperishable memories, every second at Anfield would remind them of Jota. His close friend Andy Robertson remembered him after Scotland secured its World Cup berth last week. “I couldn’t get my mate Diogo Jota out of my head today,” he said. “We spoke so much …

Sharad Pawar raises concerns over pre-poll cash transfers in Bihar

NCP (SP) president Sharad Pawar on Sunday said he plans to discuss the transfer of funds to women under a government scheme in Bihar ahead of the recent elections when he meets opposition leaders during the upcoming Parliament session. His remarks came days after the NDA secured a landslide victory in Bihar, decisively defeating the Mahagatbandhan bloc, reported news agency PTI.  “The poll outcome differed from our expectations, but one must respect the mandate of the people. In Maharashtra and Bihar, schemes like Ladki Bahin and direct transfers of Rs 10,000 to women were rolled out just before the elections, something unprecedented,” Pawar told reporters in Solapur. He was referring to the Mukhyamantri Mahila Rojgar Yojana in Bihar, which provides money to one woman in each family to start a business. Pawar noted that while fund distribution during local body elections is not unusual, providing Rs 10,000 directly to women ahead of state polls is new, as per PTI.  “If the deposit of Rs 10,000 influenced the Bihar election results, it is something we need …
