‘Constitutional morality finally comes down to justice without fear or favour’, Kapil Sibal at Justice Unplugged 2026

‘Constitutional morality finally comes down to justice without fear or favour’, Kapil Sibal at Justice Unplugged 2026

The question of constitutional morality ultimately comes down to justice without fear or favour, senior advocate Kapil Sibal said on Saturday (February 28, 2026). “The problem with our court today is that there is a breakdown of our constitutional machinery, complete breakdown,” Mr. Sibal said in a free-wheeling conversation with N. Ram, Director of The Hindu Group, at The Hindu Justice Unplugged 2026, as they discussed the erosion of constitutional morality and if public faith in the court is eroding. Edited excerpts: Constitutional morality is a powerful but apparently elusive and shape-shifting concept. It has absorbed a variety of meanings over different historical and socio-political settings and circumstances across time. In the 19th Century, George Grote used the term to convey the simple but potent idea that a Constitution survives by habits, not merely by text. Speaking in the Constituent Assembly on November 4, 1948, Dr. B.R. ‘Constitutional thinking has to start from home’, says S. Muralidhar at Justice Unplugged 2026

‘Constitutional thinking has to start from home’, says S. Muralidhar at Justice Unplugged 2026

We are in a country where we do not allow the provisions of the Constitution to influence our personal behaviour, S. Muralidhar, former Chief Justice of the Orissa High Court and now a senior advocate of the Supreme Court, said at The Hindu Justice Unplugged on Saturday (February 28, 2026). In a conversation with Krishnadas Rajagopal, Legal Correspondent at The Hindu, the eminent jurist and author said change comes from the social milieu where you grow up in your houses, in your homes and talks of how constitutional thinking has to start from home. He said it was up to each young lawyer to make the best of the initial years of struggle. Edited excerpts: KDR: Your remarks on the topic of the conversation – ‘The art of Constitutional Thinking: How great lawyers are made’  SM: Law is very much in everyone’s mind, imagination. The amount of coverage of courts and lawyers in the last two decades has been phenomenal. After the advent of social media, everyone gets to see some video clip of some lawyer in action or …

The Editor of The Hindu, Suresh Nambath, in the welcome address, welcomed the dignitaries and the audience of The Hindu’s law conclave, Justice Unplugged 2026. He said that all societies, from those of ancient civilisation to those of modern nation states, are built on the rule of law. “In India, the Constitution, and not the Parliament, is supreme,” Mr. Nambath said. He also said that even though both represent the will of the people, the Constitution represents the voice of the people across generations.
