The Supreme Court on Monday asked Tamil Nadu to raise its grievance before the Cauvery Water Management Authority (CWMA) over Karnataka’s alleged failure to release the state’s proportionate share of Cauvery water.
Appearing for Tamil Nadu, the counsel told a bench of Justices Vikram Nath and Sandeep Mehta that the state was not receiving the quantity of water it was entitled to under the applicable directions.
The bench, however, noted that Karnataka had already released water in compliance with the directions issued by the CWMA.
“You have already received the water as directed by CWMA,” the bench observed while hearing Tamil Nadu’s plea seeking directions for the release of its due share.
SC directs state to raise grievance before CWMA
Tamil Nadu’s counsel disputed the submission, arguing that the CWMA had not directed Karnataka to release the proportionate quantity of water that Tamil Nadu was entitled to receive.
In view of the disagreement between the two sides, the Supreme Court directed Tamil Nadu to approach the CWMA and place its grievance before the authority.
The matter will next be heard on August 31.
Tamil Nadu seeks 3,500 cusecs daily
The latest proceedings follow Tamil Nadu’s plea seeking enforcement of a CWMA decision directing Karnataka to release 3,500 cusecs of Cauvery water daily for 15 days.
On August 17, the Supreme Court had directed Karnataka to ensure compliance with the CWMA’s directions concerning the release of Cauvery water to Tamil Nadu.
Tamil Nadu had moved the apex court on August 3, challenging the alleged non-implementation of the CWMA’s July 30 direction concerning releases from Karnataka’s Kabini and Krishna Raja Sagara reservoirs.
The state sought a total release of 4.536 TMC, corresponding to 3,500 cusecs per day over 15 days. It had urged that the stipulated quantity be released by August 12.
DMK also seeks enforcement of directions
The DMK had separately approached the Supreme Court, seeking directions to Karnataka to immediately release Cauvery water to Tamil Nadu in accordance with the apex court’s February 16, 2018 judgment and subsequent directions issued by the Cauvery Water Regulation Committee (CWRC) and CWMA.
The party’s application sought enforcement of the CWRC’s July 28 direction, which was upheld by the CWMA on July 30. The direction required Karnataka to ensure a flow of 3,500 cusecs per day at Biligundlu for 15 days from July 29.
The DMK also sought day-to-day monitoring of reservoir releases and water flow at Biligundlu by the CWMA.
The dispute comes against the backdrop of the long-running disagreement between Karnataka and Tamil Nadu over sharing of Cauvery river waters.
