Ranveer Allahbadia Case News: The Supreme Court on Tuesday rapped YouTuber Ranveer Allahbadia for his “highly irresponsible” remarks on ‘sex with parents’ on comedian Samay Raina’s now-deleted web show ‘India’s Got Latent’.

A bench of Justice Surya Kant and Justice N Kotiswar Singh delivered a stinging rebuke of Allahbadia’s remarks while hearing Allahbadia’s plea seeking to club FIRs filed across various states, including Maharashtra and Assam.

Appearing for Allahbadia, advocate Abhinav Chandrachud, said there are death threats against him. The Supreme Court bench came down heavily on the counsel, saying, “Are you defending the kind of statements made?”

‘Why Should The Court Favour Him?’

Allahbadia’s counsel told the court that he was personally “disgusted” by the remarks made on Raina’s show, but whether it rises to the level of criminal offence is another question. To this, the court asked, “What is the parameter of obscenity? This is Indian society. We would like to know, in this country, if this is not obscenity, then what is?”

“There is a height of irresponsibility. They believe that since they’ve become popular they can say anything. There’s dirt in his mind. Why should the court favour such a person?” the court further said.

Allahbadia’s counsel cited complaints against the podcaster from all over the country and said the Guwahati FIR constituted an “abuse of process”. However, Justice Kant said the complaint deals with two different kind of offences and asserted that it was not a question of the individual’s morality.

‘Daughters And Sisters Will Feel Ashamed’

The two-judge bench said Allahbadia’s comments must be condemned. “You tell us anyone in the world who would like such words,” remarked Justice Kant.

When Chandrachud cited threats of acid attacks against one of the co-accused and another threat of cutting off Allahbadia’s tongue, the court said, “If you can seek cheap publicity by using abusive language, this person extending threat is also seeking publicity.”

“The words you have chosen, parents will be ashamed, daughters and sisters will be ashamed. The entire society will feel ashamed. The perverted mind. These are the levels of depravity you and your henchmen have gone. We have a judicial system, bound by the rule of law. If there are threats, the law will take its course,” further said Justice Kant.

‘We Are Not In Ivory Towers’

Justices Kant and Singh assured that the state would provide necessary protection from the threats, as Chandrachud brought up Allahbadia’s claims that people are entering his mother’s clinic posing as patients and threatening her.

“He should be ashamed as to what he has done to his parents. We are not living in ivory towers. We know how he copied the question from an Australian show. There are certain societies where they warn those who are not supposed to watch the programme… they maintain precautions,” said Justice Kant.

In reply, Chandrachud said it was meant for adults who could pay for it to watch the episode. He said a subscriber made a copy of the 10-second clip out of a 45-minute show.

Interim Relief For Allahbadia, Lawyer Not Allowed In Police Station

The court later stayed the FIRs in Maharashtra and Assam on the condition that Allahbadia cooperate fully with the investigation and said he would not be accompanied by his counsel inside the police station.

The court said that no FIR shall be registered against the YouTuber in connection with India’s Got Latent and he would be required to deposit his passport with the Thane Police. Allahbadia has also been barred from leaving the country without the permission of the apex court.

YouTubers Barred From Doing Other Shows

The Supreme Court also restricted Allahbadia, Samay Raina and Apoorva Mukhija from airing any show till further orders.

The Court directed that the interim relief is subject to the condition that the petitioner or his associates shall not air any other show till further orders.
