Allahabad High Court Upholds Mosque Eviction from Gram Sabha Land in Lucknow

4 min readNew DelhiUpdated: Mar 27, 2026 10:33 AM IST The Allahabad High Court recently dismissed a plea against eviction order passed in connection with a mosque constructed on gram sabha land in Bakshi-Ka-Talab, Lucknow while partially granting relief by setting aside a monetary penalty imposed on the petitioners. Justice Alok Mathur passed the order on a plea filed by one Shahban and others who had challenged orders passed by district authorities directing eviction and imposing a penalty of Rs 36,000 for allegedly constructing a mosque on the subject land. “Petitioners were unable to demonstrate that they had any right, title, or interest in the said land,” the court noted on March 25. In its order delivered on Tuesday, a bench of Justices Salil Kumar Rai and Dr Ajay Kumar II also questioned the prosecution for not examining the doctor who conducted the medical examination of the girl and the trial court for not summoning the doctor as a court witness to explain the medico-legal report. Last Updated:March 03, 2026, 16:18 IST The Allahabad High Court ruled that addressing someone by their profession isn’t an offence under the SC/ST Act unless intended to insult Allahabad High Court (File pic) In a significant ruling, the Allahabad High Court has observed that merely addressing a person by their profession does not constitute an offence under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, unless it is established that the words were used with deliberate intent to insult a member of the Scheduled Caste or Scheduled Tribe community. The observation was made by a single-judge Bench of Justice Anil Kumar while hearing a petition challenging a summoning order issued in August 2024 by a special SC/ST court in Gautam Buddha Nagar district. The appellant had been summoned under Sections 323, 504 and 506 of the BNS, along with Sections 3(1)(d) and 3(1)(dh) of the SC/ST Act. File | Photo Credit: PTI The Allahabad High Court on Friday (February 27, 2026) granted interim protection from arrest to Swami Avimukteshwaranand Saraswati, head of the Jyotirmath monastery, who faces allegations of sexually assaulting two minors at his ashram. Justice Jitendra Kumar Sinha extended similar relief to the seer’s disciple, Swami Mukundanand Giri. The court, however, clarified that the investigation would continue in accordance with the law. While reserving its order on interim bail, it directed both accused to cooperate fully with the ongoing probe. The matter is scheduled for further hearing on March 12. The FIR against the two Mr. Saraswati and Mr. Giri was registered following directions from a special court in Prayagraj.
