The revised schedule was issued by the poll panel on August 19 following a request from the Maharashtra Chief Electoral Officer (CEO). The Supreme Court on Tuesday heard petitions challenging the Maharashtra Assembly Speaker’s decision not to disqualify legislators from the Eknath Shinde-led faction of the Shiv Sena under the Tenth Schedule of the Constitution, news agency ANI reported. The Uddhav Thackeray-led faction argued that a split in the legislative wing of a political party cannot, by itself, be treated as a split in the political party. Senior advocate Kapil Sibal, appearing for Shiv Sena (Uddhav Balasaheb Thackeray), submitted that the Election Commission of India (ECI) could exercise jurisdiction under Paragraph 15 of the Election Symbols (Reservation and Allotment) Order, 1968, only when there was a split in the political party resulting in two rival groups. Paragraph 15 empowers the ECI to decide disputes when rival groups or factions of a recognised political party claim its name and election symbol. The Delhi High Court on Tuesday directed the Election Commission of India (ECI) to ensure that election-related duties assigned to schoolteachers do not impose an “unbearable” burden on them, observing that teachers engaged in poll work after spending 6-8 hours in classrooms may undergo considerable stress. A Division Bench of Chief Justice Devendra Kumar Upadhyaya and Justice Tejas Karia passed the direction while hearing a public interest litigation (PIL) challenging the deployment of government school teachers for the ongoing Special Intensive Revision (SIR) of electoral rolls in the national capital. The Delhi High Court said that while there was no dispute regarding the ECI’s constitutional authority to requisition teachers for election-related work, the mandate of Section 27 of the Right of Children to Free and Compulsory Education (RTE) Act, 2009, could not be overlooked. The Election Commission of India (ECI) has announced a one-time additional payment of ₹6,000 each for Booth Level Officers (BLOs) and their supervisors engaged in the ongoing third phase of the special intensive revision (SIR) of electoral rolls, a move aimed at recognising their contribution in the process, EC officials said.The incentive was first introduced for Bihar, the pilot state for the extensive exercise. This will motivate them to perform their duties to the best of their ability,” a senior ECI official said.
