HC: PMLA overrides debt recovery laws for attachment of ‘proceeds of crime`

The Bombay High Court (HC) has held that the Prevention of Money Laundering Act (PMLA) has an overriding effect over debt recovery laws such as the SARFAESI Act and the Recovery of Debts and Bankruptcy (RDB) Act when it comes to the attachment of “proceeds of crime”, news agency PTI reported. In a judgment delivered on March 23, the Nagpur bench set aside previous orders of the PMLA Appellate Tribunal, which had favoured banks’ rights to recover debts from attached properties. The bench, comprising Justices MS Jawalkar and Nandesh Deshpande, observed that debt recovery laws like SARFAESI and RDB “would not render PMLA subservient to them due to the distinct objects and purposes of the two enactments”. The court emphasised that PMLA’s legislative objective of confiscating proceeds of crime is separate from the debt recovery framework, and hence, debt recovery laws cannot override the Act. The case dates back to a 2012 Central Bureau of Investigation (CBI) probe into Grace Industries Ltd over irregularities in coal block allocations. Finance and Corporate Affairs Minister Nirmala Sitharaman on Monday introduced the Corporate Laws (Amendment) Bill, 2026, which seeks to amend the Limited Liability Partnership Act, 2008 and the Companies Act, 2013, in the Lok Sabha. The Bill has been referred to a 31-member Joint Committee of Parliament for a detailed analysis. The committee, comprising 21 Lok Sabha Members to be chosen by Lok Sabha Speaker Om Birla and 10 Rajya Sabha Members to be selected by Chairperson and Vice-President C P Radhakrishnan, will submit its report on the last day of the first week of the Monsoon Session. The Amendment Bill, which aims to streamline the regulatory processes for companies, decriminalise minor offences by shifting from criminal penalties to monetary fines in order to reduce the compliance burden on businesses, was referred to the the House panel amid questions from the Opposition MPs in the Lok Sabha. Parliament Budget Session LIVE: Nirmala Sitharaman to introduce Corporate Laws (Amendment) Bill in Lok Sabha

With the second leg of the Parliament Budget session set to resume today, Union Finance Minister Nirmala Sitharaman will introduce the Corporate Laws (Amendment) Bill, 2026, further to amend the Limited Liability Partnership Act, 2008 and the Companies Act, 2013. According to the List of Business issued by the Secretary General of Lok Sabha, the Union Finance Minister will also move that the Finance Bill, 2026, which will give effect to the financial proposals of the Central Government for the financial year 2026-2027, be taken into consideration. The Lok Sabha is scheduled to commence proceedings for the ongoing second phase of the Budget Session at 11 a.m. today. Section 17A of the Prevention of Corruption Act, 1988 (PCA) came under the spotlight after a two-judge bench of the Supreme Court last month delivered a split verdict in a petition challenging its constitutionality.  Justice K V Viswanathan upheld the provision and quoted Sardar Vallabhbhai Patel’s reference to civil servants as the “Steel Frame of India”, underlining that without a basic assurance of protection, “public servants will resort to a play it safe syndrome”. The Marylebone Cricket Club (MCC), which maintains the laws that govern professional cricket, on Tuesday announced 73 changes that will come into effect from October 2026. It hasn’t made wholesale changes to how the sport is played, with the tweaks largely focussing on tightening definitions around dismissals, overs and player positioning. One of the key updates is that wicketkeepers will no longer be penalised for having their gloves in front of the stumps when the bowler runs up. The new laws also require the bowling side to complete the final over of the day even after a wicket falls in red-ball cricket. The current practice is for Stumps to be called if a wicket falls in the final over of the day, with the rest of the over being completed at the start of play on the next day. “It was felt unfair that, if a fielding side takes a wicket in the final over of the day, the batting side does not have to send out a new batter,” MCC said. “This doesn’t save …

The Ministry of Home Affairs (MHA) is set to present a special tableau at the 77th Republic Day Parade on Kartavya Path, highlighting the nationwide implementation of the three new criminal laws that came into force on July 1, 2024. As per the MHA, the tableau will showcase the implementation of the Bharatiya Nyaya Sanhita, Bharatiya Nagarik Suraksha Sanhita and the Bharatiya Sakshya Adhiniyam, replacing colonial-era laws Indian Penal Code (IPC), 1860; Code of Criminal Procedure (CrPC), 1973; and the Indian Evidence Act, 1872. The new laws, collectively referred to as the `Naveen Nyaya Sanhita`, mark a comprehensive overhaul of India`s criminal justice system, replacing British-era statutes with a modern, Indian-centric legal framework. Described as one of the biggest legal reforms of the century, the new laws replace the colonial-era framework based on punishment with an Indian philosophy centred on justice, symbolised by the theme “Dand Se Nyay Ki Or” (from punishment to justice).
