The Chhattisgarh government has amended its Minor Mineral Rules to introduce stricter penalties and tighter enforcement measures against illegal mining, transportation and storage of minerals under the leadership of Chhattisgarh CM Vishnu Deo Sai. With new rules in place, offenders face substantial fines and stricter regulations, fostering a more accountable mining sector in the state. Higher penalties, stricter vehicle release norms Under the amended rules, the minimum compounding amount in all cases of illegal excavation and transportation has been fixed at ₹25,000. Offenders involved in illegal transportation will also have to pay ₹2,000 per tonne in addition to the full value of the illegally transported mineral. The government said a vehicle transporting 35 tonnes of minerals illegally would now attract a compounding charge of ₹70,000 apart from the mineral’s value. The home ministry has revised the compounding penalties for a number of offences under the Foreign Contribution (Regulation) Act (FCRA), 2010. Supreme Court rules High Courts cannot waive stamp duty penalties

The Supreme Court has ruled that a High Court cannot waive the statutory penalty payable on deficient stamp duty, holding that such power lies exclusively with the competent authority under the relevant Stamp Act.   In a significant judgment, a bench of Justices Sanjay Kumar and K. Vinod Chandran set aside a Karnataka High Court order to the extent it had exempted payment of penalty while directing payment of deficient stamp duty on lease documents.  The apex court was dealing with an appeal arising out of a long-pending partition suit filed in 2008, where the admissibility of two lease documents was contested on the ground of insufficient stamping.  The Justice Sanjay Kumar-led Bench clarified that once an instrument is found to be insufficiently stamped, its impounding is mandatory under the Karnataka Stamp Act, 1957, and the statutory scheme leaves no room for courts to dilute penalty provisions in the manner adopted by the High Court.  “The High Court cannot, by itself, direct payment of stamp duty and absolve the penalty which is otherwise mandated under …

GBA announces penalties for trade licence renewals in Bengaluru

Maheshwar Rao has issued a circular outlining the process and conditions for renewal of trade licences across the five city corporations to streamline the renewal process while ensuring compliance with zoning, building, waste management and public health regulations.  Traders will be allowed to renew their trade licences for a period ranging from one to five financial years, from April to March, based on their preference. The renewal fee will be calculated only for the number of years sought by the applicant. The GBA has also laid down a graded penalty structure for delayed renewals. Traders who pay the licence fee between February 1 and February 28, will not be charged any penalty. Payments made between March 1 and March 31 will attract a penalty of 25% in addition to the licence fee. From April 1 onwards, a 100% penalty will be imposed along with the applicable licence fee. Several conditions linked to solid waste management and public health have been made mandatory for renewal such as establishments generating more than 100 kg of …

In a major relief for city residents, industrialists and traders, the Chandigarh Administration has sent a proposal to the Ministry of Home Affairs (MHA) seeking an amendment to the Capital of Punjab (Development and Regulation) Act to rationalise penalties imposed in thousands of building violation cases. At present, more than 5,000 notices related to building violations are pending across Chandigarh, primarily involving industrial units and commercial properties. Once Parliament approves the proposed amendment, the UT Administration will be empowered to revise and rationalise penalties at its own level, paving the way for the settlement of these long-pending cases. The demand for rationalising penalties has been raised by the city’s business community for several years. However, the issue could not be addressed earlier as any change in penalty structure requires a statutory amendment to the Act. With the proposal now forwarded to the Centre, a resolution appears to be in sight.
