Analysis: As FCRA restricts NGOs, Supreme Court had agreed that right to associate is not carte blanche for foreign funds

These amendments, and the ones before them, source their legality from the Centre’s argument in the Supreme Court that the freedom to form associations or engage in the “business” of charity does not include a right to receive unbridled foreign funds or to use the money outside “permissible activities”. Among other changes, Rule 9(1B) mandates that certificates of registration of NGOs must specify the “purpose or purposes and the States or Union territories”. The Rules limit NGOs to specific and stated spheres of activity, which exclude proselytisation and geographical bounds. Amid the LPG crisis, the Ministry of Petroleum and Natural Gas has issued a notification, stating that the households that already have a connection for Piped Natural Gas (PNG) will no longer be allowed to retain a domestic Liquefied Petroleum Gas (LPG) connection. The government notification stated that such consumers must immediately surrender their LPG connections and will not be eligible to receive LPG cylinder refills from government oil companies or their authorised distributors. “No person having a piped natural gas (PNG) connection and also having a domestic LPG connection shall retain a domestic LPG connection, or take refills of domestic LPG cylinders from any Government oil company, or through their distributors. Such persons will be required to immediately surrender their domestic LPG connection,” the notification stated. It also clarifies that individuals who already use PNG for domestic cooking will not be allowed to apply for a new LPG connection in the future. In a setback to the state government, the Karnataka High Court has barred it from issuing any fresh recruitment notifications in an Act which had raised quotas for Scheduled Castes and Scheduled Tribes. The restriction on recruitment under the Karnataka Scheduled Castes (SCs) and Scheduled Tribes (STs) (Reservation of Seats in Education Institutions and Appointments of Posts and Services under the State) Act, 2022, will remain until further orders. However, the HC bench allowed the government to continue recruitment processes already notified before November 19, 2025, even if they follow the increased reservation percentages. The court also clarified that all appointments made through these ongoing recruitments will be subject to the final outcome of the petitions challenging the law. The division bench of Chief Justice Vibhu Bakhru and Justice C M Poonacha issued the interim order on November 27 while hearing two PILs filed by Mahendra Kumar Mitra of Raichur and Mahesh of Bengaluru.
