Supreme Court upholds 28 per cent retrospective tax on online gaming | Business News

2 min readMay 28, 2026 01:43 AM IST In a major ruling, the Supreme Court Wednesday upheld the decision of Goods and Services Tax (GST) authorities to demand 28% retrospective tax on online gaming. A bench of Justices J.B. Pardiwala and R. Mahadevan said “online gaming activities, including fantasy sports and other games played on digital platforms, involving staking upon uncertain outcomes, constitute betting and gambling for the purpose of GST framework”. The court held that GST levy on online gaming is constitutionally valid. “GST of the supply of actionable claims arising from betting and gambling is constitutionally valid and does not transgress Articles 366(12) (which defines goods) and 366(12A) (which defines GST) of the Constitution,” the bench said. The top court was hearing an appeal by the Directorate General of Goods and Services Tax Intelligence (Headquarters) challenging a Karnataka High Court judgement which quashed the GST department’s show cause notice issued under the CGST Act to online gaming company GamesKrraft Technologies Pvt Ltd seeking payment of Rs 21,000 crores dues. Los Angeles, The Toronto International Film Festival will screen all 12 films directed by Christopher Nolan as part of a retrospective ahead of the Oscar-winning filmmaker’s upcoming film “The Odyssey”. In April 1917, the French-American artist famously submitted an inverted urinal brought from a store, signed and dated “R. Mutt, 1917,” to the Society of Independent Artists’ salon in New York, which claimed to be “unjuried”. Associated with the Dada movement (that questioned traditionlal values in art in post World War 1 Europe), Duchamp reportedly wanted to test that claim. Section 19 of the Prevention of Money Laundering Act deals with the power to arrest (ANI) The top court’s remarks came at a time when several petitions have been filed across courts, alleging illegal arrests by ED on the grounds that the federal agency had only orally intimated the grounds of the arrest to the accused. In its October 3 ruling, in the Pankaj Bansal v Union of India case, the top court said: “We hold that it will be necessary for a copy of grounds of arrest to be furnished to the accused at the time of arrest.” While the ruling held that it will apply to cases “henceforth”, a petition was filed by Supertech founder Ram Kishore Arora, alleging he was not given …
