Image Source : PTI Tahir Hussain (Centre) Former AAP politician Tahir Hussain, accused in a murder case related to February 2020 riots and AIMIM leader was on Tuesday granted custodial parole to file a nomination for the upcoming Delhi Assembly elections. Delhi police opposed a plea of Hussain. Saying contesting elections was not a fundamental right, the police alleged Hussain who was the “main conspirator” and “funder” of the February 2020 riots could complete formalities and fight polls on custody parole. Hussain, in the bail plea, said he spent 4.9 years in jail and though the trial started in the case, only 20 of the 114 prosecution witnesses were examined so far. The Delhi High Court instructed that Tahir Hussain will not use his mobile phone, landline phone or internet during nomination. He will also not talk to anyone except officials related to the nomination process. The AIMIM will not even address the media. AIMIM has fielded Shafur Rehman as a party candidate from Okhla. He is the chairman of the Jamia Alumni Association.  Posting on X, the party said, “An appeal is made to all the voters of the Okhla Assembly constituency to make Shafa ur Rehman Khan victorious with the largest number of votes by pressing the button on the kite symbol on February 5.” According to the information, he was also active during the CAA protest in Jamia and Shaheen Bagh. He is currently lodged in jail. He is fielded against Aam Aadmi Party candidate and incumbent MLA Amanatullah Khan. Rehman is the second accused in the 2020 Delhi riots case who has been given a party ticket in Delhi. The Delhi High Court on November 26 quashed and set aside a second FIR lodged at the Khajuri Khas police station regarding the 2020 Delhi riots stemming from the same incident against former Aam Aadmi Party (AAP) councillor Tahir Hussain. The court directed that the chargesheet from the second FIR be treated as a supplementary chargesheet in the first FIR. Two FIRs were lodged stemming from a single incident of riots on February 24, 2020, that occurred in the same premises, except one occurred on the ground floor and the second on the first floor of the building. The first FIR was lodged on February 25 based on a complaint by a constable booking Hussain for the offences of rioting, mischief by fire, and trespassing under the Indian Penal Code (IPC) as well for offences under the provisions of the Prevention of Damage to Public Property Act. The Delhi High Court on Tuesday reserved orders in a plea by former AAP councillor Tahir Hussain seeking quashing of one of the First Information Reports against him and the subsequent proceedings, including the charges framed against him in relation to the same FIR. Hussain is facing allegations of rioting, criminal conspiracy and promoting communal enmity as well as offences under the Arms Act in relation to the 2020 North East Delhi riots. Two FIRs were lodged against Hussain for similar offences from one incident, only differentiated by the place of offence — one for the offence committed on the ground floor of the building and another on the first floor of the same building. The two FIRs were lodged at the Khajuri Khas Police Station.
