Unions raise concerns about overtime, definition of factory in draft code published by Karnataka govt

The draft rules for the Occupational Safety, Health and Working Conditions Code, published by the Karnataka government on January 27, have capped the daily working hours at 10.5 hours, stipulating that a worker cannot be made to work more than 48 hours in a week. It further notes that the working day can be extended up to 12 hours for certain factories or categories of workers, if notified by the State Government.  This appears to be in the same vein as the proposed amendment to the Karnataka Shops and Commercial Establishment Act, 1961, in June, 2025. The proposal then suggested increasing the daily working hours to 10 from the current nine hours, and to cap the total number of work hours at 12 a day, including overtime, inviting severe criticisms from trade unions.   Rest and overtime According to the rules, in case of overtime, the worker shall be eligible for compensation, which is twice his ordinary rate of wages.   While the draft rules limit overtime to a maximum of 144 hours in a quarter, this figure is almost thrice the existing limit. As per the Karnataka Shops and Commercial Establishments Act, 1961, the total overtime worked must not exceed 50 hours in …

The strike call by the UFBU, an umbrella body of nine unions representing officers and employees, comes after a conciliation meeting on January 23 with the Chief Labour Commissioner failed to yield a positive outcome. A joint platform of ten Central Trade Unions (CTUs) has given a call here on Tuesday (December 21, 2025) for a general strike on February 12, 2026 against the implementation of the four new Labour Codes, amendments to MGNREGA, Insurance Act and various civil nuclear liability and nuclear energy laws. The CTUs, in a joint statement, alleged that the changes in the laws are a multi-pronged attack on people’s rights and entitlements. A national convention of workers, scheduled here on January 9, will formally ratify the call to strike. ‘Blatant attacks on people’ “If the government still tries to pursue the notification of rules under the codes and does not repeal them, the CTUs will be compelled to go for further strong actions, including a multiple-day general strike, besides sectoral resistance actions,” the statement said. West Bengal’s decision to allow tea gardens to use 30% of the land for purposes other than tea cultivation so estate owners can explore alternative businesses has evoked a strong response from tea garden unions and Opposition parties.
