In a significant move aimed at streamlining law enforcement procedures, the Delhi Lieutenant Governor (L-G) V K Saxena on Monday issued a new directive, expanding the investigative powers of various police officers under the Indian Civil Defence Code, 2023.
The directive, issued in accordance with the powers conferred by Section 176 of the Indian Civil Defence Code, 2023, outlines specific investigative roles for different ranks within the Delhi Police.
“Under the new directive, inspectors are now tasked with investigating cases under the Indian Code of Criminal Procedure, 2023, as well as all local and special laws, unless specified otherwise by those laws. Sub-inspectors and assistant sub-inspectors will handle cases under the Indian Judicial Code and local laws, with the exception of murder cases as defined under section 103 (1) of the BNS,” an official from the L-G office said.
Officials said that head constables will be responsible for investigating cases under the Indian Penal Code, 2023, and related local laws where the maximum prescribed punishment is up to seven years.
Additionally, constables who have a graduation degree, have completed a decade of service as well as investigation training will be authorised to investigate cases with a maximum punishment of three years, provided no other law assigns this power to a specific rank, the officials added.
The officers designated under this new framework will have comprehensive investigative responsibilities, including maintaining daily diaries, preparing case files, making arrests, and attending court proceedings.
This move is expected to enhance the efficiency and effectiveness of investigations across Delhi, said officials.
Further, officials said that the decision underscores the Delhi administration’s commitment to refining its legal processes and improving the operational capabilities of its police force.
