The Delhi High Court on Thursday agreed to hear a Public Interest Litigation (PIL) seeking a National Investigation Agency (NIA) probe into the violence that allegedly took place during the July 20 “Chalo Sansad” protest over the alleged NEET paper leak.
The petition seeks the transfer of all First Information Reports (FIRs) registered by the Delhi Police in connection with the incident to a specialised investigating agency and requests action against those allegedly involved in the violence.
High Court lists PIL for hearing on Friday
The matter was mentioned before a Division Bench comprising Chief Justice D.K. Upadhyaya and Justice Tejas Karia.
Appearing for the petitioner, Advocate Barun Kumar Sinha requested the court to hear the matter on an urgent basis. Accepting the request, the Bench listed the PIL for hearing on Friday.
Petition filed by former Akhil Bharat Hindu Mahasabha office-bearer
The PIL has been filed by Satish Kumar Aggarwal, a former Vice-President of the Akhil Bharat Hindu Mahasabha, through advocates Sneh Vardhan and Pratibha Sinha.
The respondents named in the petition include the Union of India, the National Investigation Agency (NIA), the Central Bureau of Investigation (CBI), the Delhi Police Commissioner and the Government of the National Capital Territory (NCT) of Delhi.
Petition seeks transfer of FIRs and specialised probe
According to the petition, protests over the alleged NEET paper leak began at Jantar Mantar on June 6, 2026, and culminated in the “Chalo Sansad” march on July 20.
The petitioner has alleged that the demonstration turned violent, leading to incidents of stone-pelting, injuries to police personnel, attacks on journalists, damage to public and private property, obstruction of emergency services and attempts by protesters to move towards Parliament House.
The PIL seeks directions for the NIA or another specialised investigating agency to investigate the July 20 incident, including the alleged attempt to breach the Parliament area and attacks on security personnel.
It also seeks the transfer of all FIRs registered by the Delhi Police in connection with the incident to the investigating agency for a consolidated probe.
Plea seeks identification of those responsible for violence
The petition has further requested the High Court to direct authorities to identify all individuals allegedly responsible for violence, vandalism, damage to public and private property and obstruction of emergency services.
It also seeks directions to register FIRs wherever necessary and initiate legal action against those found responsible in accordance with the law.
Petition raises allegations over funding and political involvement
The PIL alleges that the agitation, which initially began as a protest against the alleged NEET examination paper leak, was later influenced by political leaders and other groups.
It also raises allegations regarding foreign funding and the involvement of certain activists and organisations, and seeks an investigation into those aspects. These allegations are part of the petition and are yet to be examined or adjudicated by the court.
The petitioner has argued that while the right to peaceful protest is protected under the Constitution, it cannot be used as a cover for violence, destruction of property or acts that allegedly threaten public order and national security.
The Delhi High Court is expected to hear the matter on Friday.
