When will final report be given to trial court after probes in 16 cases against Mohali realtor: High Court to Punjab | Chandigarh News


The Punjab and Haryana High Court has directed the state of Punjab to file an affidavit by mentioning the time frame in which the final report will be presented to the trial court after completion of investigation in the 16 pending cases against Mohali-based realtor, Jarnail Singh Bajwa.

The Bench of Justice Sandeep Moudgil has sought the affidavit from Punjab Police while hearing a petition filed by Kuldeepak Mittal against the state of Punjab and other respondents.

During the previous hearing, the HC had issued a contempt notice to the Mohali realtor for not appearing on multiple occasions before the HC, and also had asked him to furnish the details of moveable and immovable properties possessed by him.

As the matter came up for hearing on Tuesday, Bipan Ghai, Senior Advocate, appeared on behalf of Bajwa and prayed for more time to file reply to the show-cause notice as well as to provide the details of moveable and immovable properties.

On it, Justice Moudgil granted last opportunity to Bajwa to do the needful, forcing the court to observe that “prima facie it seems a deliberate and intentional attempt to subvert the proceedings and to derail the judicial process”.

The HC was also apprised by the counsel for petitioner that apart from the FIRs registered against Bajwa, there were multiple cases involving similar offences wherein the matter is pending before the district/state consumer disputes redressal forums.

On this, the HC also directed the petitioner to furnish the details of any other litigation, including the cases pending before the district/state consumer disputes redressal forum as well as private complaints pending in any court of law.

A D S Sukhija, Additional AG Punjab, appearing for Punjab, informed the court that in 16 FIRs within Mohali, investigation is still pending against Bajwa, and a final report has been presented to the trial court in six cases on different dates and in other two cases it is under check/approval of the competent authority.

Adjourning the matter for September 19, the Bench directed the state to file an affidavit by mentioning the time frame in which the final report will be presented to the trial court after completion of investigation in the other pending cases which are 16 in number confined to Mohali as well as for all other police stations wherein he has FIRs registered against him, including NRI police stations.
